my opinion is that npower was purchased by eon.  Npower didnt go bust, all npower liabilities are owned by Eon.

Usually before small claims you go through arbitration, what did npower do at arbitration?  Did they reply or ignore?  it is odd that npower could be claimed against in 2021 since E.on took over in 2019.  That being said, they still exist as a limited company and file accounts.

    personally? registered letter to eon
Court orders cannot simply transferred from one company to another. If Eon took over the liabilities in 2019 then the OP should have made the claim directly against them, but they appear to have claimed against the wrong company at the wrong address, which has resulted in a default judgement which will almost certainly going to be be set aside if the OP tries to enforce it.

From the last accounts. NPower was sold to E.oN UK on the 11th February 2020 with all NPower consumers transferred to E.oN Next.

The customers  weren’t all transferred straight away though.

I was with npower and only transferred to Eon.next in May 2021 (I still have the  ‘Welcome to Eon.next' letter dated 15th May 2021).

Infact for the OP - I have e-mail corrspondance from npower, with their Houghton Le Spring address on, dated the 15th April 2021 - so they were still operating at Houghton Le Spring then.

My query is where do I send the Court Order to and how do I know if tge claim was ever received in the first instance by Npower.
In your position I would send the order to npower's registered address, by tracked post (ideally signed-for).
    Registered office address
Windmill Hill Business Park Whitehill Way, Swindon, Wiltshire, SN5 6PB
That has been npower's registered address for quite some time; why did you use a Houghton-le-Spring address for the initial docs in April?
    Thank you everyone..
I sent the documents to the address in Houghton-le-Spring as this was the address provided by Npower in when I contacted them in March.
I took this to the Ombudsman and I was still receiving communication from Npower from this address prior to the small claim being submitted in April this year.

Court orders cannot simply transferred from one company to another. I'm sorry I am rather confused by the whole situation. I was still an Npower customer in November 2020 and when I contacted the Ombudsman about my issue I have a letter from npower from March 2021 with the address of Houghton-le-Spring on it. Before I submitted the claim I telephoned npower to check if this was the correct address.
Nothing the Court has sent to Npower has been acknowledged.
    Thank you for your advice.

You can use the registered address of a limited company (where delivery of a legal notice is deemed as served on that company), or an address you are aware they actively trade from.

There is normally no obligation on any recipient to acknowledge service.

In which case the OP should the be able to enforce the claim against nPower, but they have no claim against Eon.

Thank you, I have emailed the court.to send any further correspondence to Npowers registered address in Wiltshire.
Thank you for your help and advice.
  • You might be better off sending the documentation to E.ON's registered address in Coventry.
