Court Order against Npower

Options
I have an ongoing unresolved complaint against Npower.
In April this year I submitted a small claim against Npower and the documents were sent to their address at Houghton-le-Spring.

My claim wasn't defended and a hearing took place last month. No one from Npower turned up to the hearing and the judge is now in the process of compiling a Court Order against Npower.

It is my understanding that EOn Next have now taken over from Npower and dealing with their complaints.

My query is where do I send the Court Order to and how do I know if tge claim was ever received in the first instance by Npower.

I have emailed EonNext and spoken to a customer service representative. My emails have not been acknowledged and the customer service gentleman was rude and dismissive. He likened my claim to that of a limited company going bust.

I am really at a loss..this has been ongoing for a year. If anyone could help me at all I would be very grateful.

Thank you.

In your position I would send the order to npower's registered address, by tracked post (ideally signed-for).
    Registered office address
Windmill Hill Business Park Whitehill Way, Swindon, Wiltshire, SN5 6PB
That has been npower's registered address for quite some time; why did you use a Houghton-le-Spring address for the initial docs in April?

You will have a court order against a company that is in administration, you still serve it on the administrators of the company but your chances of getting anything are slim.
E.ON Next have no part in this process and you cannot serve anything on them.
I don't think npower are in administration?
Admittedly there are several different businesses trading as npower but most of the likely suspects are still showing as going concerns at Companies House?

NPower was taken over by E.oN and all customers were placed with E.oN Next. E.oN is in the process of moving its customers on to the E.oN Next platform. I suspect that the OP is going to need legal opinion. Most companies set up satellites to limit parent company liabilities. I confess that I have no idea whether this has any impact on Court Orders.

As it appears you had the claim submitted to the wrong address, do not be surprised when nPower apply to have the order struck off.

my opinion is that npower was purchased by eon.  Npower didnt go bust, all npower liabilities are owned by Eon.

Usually before small claims you go through arbitration, what did npower do at arbitration?  Did they reply or ignore?  it is odd that npower could be claimed against in 2021 since E.on took over in 2019.  That being said, they still exist as a limited company and file accounts.

    personally? registered letter to eon

From the sound of things the original notice of proceedings was not properly served in the first place, but as suggested above the court order should be served at the registered address.
The route to E.ON from NPower is going to be tricky as it is the German parent that acquired the German company 'Innogy' which owned NPower and then transferred the customers to the UK entity.

Why was there a court hearing for an uncontested claim???

The purpose of a hearing is usually to allow the judge to establish the underlying truth of a contested claim, and then issue judgement. Judgement is usually given in the hearing, and a formal written record issued by close of business that day.

You don't have to send a small claim court order anywhere. It is 'served' (as the legal profession calls it) by the court.

  • From the last accounts. NPower was sold to E.oN UK on the 11th February 2020 with all NPower consumers transferred to E.oN Next.
