I am not following, that was my statement and it was answered by KeithP and Redx or are you clarifying the importance of sharing the experience of the case so other drivers can benefit as well?

I think our octogenarian regular was reading the thread from the start and responded to your post from October last year, perhaps not noticing the date of that posting, or that things have moved on since.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hello guys, just to update on my previous post. I have not received any confirmation from the court that they actually received a notice of discontinuation from the claimant's legal representative, this proves my worries that the claimant's representative was just trying to trick me to believe they have filed the notice of discontinuation in order for me not to appear in court and they win. Their letter stated '' we enclose by way of service our client's Notice of discontinuation, a copy of which have been filed at court. they went on saying they have discontinued the claim and their files should be closed immediately. since I have not received confirmation from court then I am going to prepare my witness statement and file to the court as soon as possible because I only have one month and 10 days before deadline.

Have you asked the court for confirmation of the Discontinuance?

Although they are supposed to notify you, it wouldn't hurt to ask the court that, and it would save you the effort of preparing and filing a Witness Statement and evidence.

Thanks Keith, I have called them many times and no one eve answer the phone, yesterday I waited on the phone for one hour and no one picked the phone '' your call is important and keep on holding someone will answer '' something like that. I have 17 days left to hearing date so I will just finish my witness statement and send it. One more question please, can I email the witness statement to the court and claimant or must I post?

You should be able to send witness statement by e-mail, certainly to the court and to the claimant (or their solicitors) if they have corresponded with you by e-mail previously.

Hi guys, just to update from my last post. I went on and prepared my witness statement and evidence and sent them to both court and claimant's legal representative. This afternoon I received a confirmation from court that the case has actually been discontinued. (hopping to remain discontinued even after sending this witness statement to the claimant's legal representative). Let me thank everyone for your kindness and help, when I joined this forum I was completely blind on what to do and without your help this would have been mission impossible.

Happy to help and nicely done!

    ANOTHER ONE BITES THE DUST!

If it helps, in the cases I've lay repped I have also never convinced a Judge to order costs at all. They just say no, it's a small claim.

Please focus your energy on this (below) as your final PPC and roboclaim scam fightback effort.

We need you to be here alongside us just once more please.

All this court claim harassment and adding a false 'DRA fee' layer that was never incurred, is partly a way to gaslight and intimidate people into paying more, and partly it funds the 'race to court' roboclaim culture you've just experienced.

    Both of which must end.

And that's what we want you to tell the Government. As we will (again...this will be the 3rd and final Public Consultation)!

IMPORTANT - IF YOU WANT TO CHANGE THE LAW ON THIS:

Please read this and come back in good time for the upcoming Public Consultation (date TBA - I now suspect the Autumn) that you will no doubt be keen to respond to:
    https://forums.moneysavingexpert.com/discussion/6371803/time-limits-on-pcn-court-claims#latest

Read it if you didn't know the Govt very nearly got a statutory ban on DRA +£70 extortion over the line, and lower parking charge levels, but the moneymen have temporarily blocked it last month, and threw their toys out the pram.

We need high numbers of genuine victim respondents to unblock it again
