Clocked Car

Hey All, 

I bought a Mercedes Eclass 2018 for £29,995 on September 11th 2021 on Finance Hire Purchase (£16000 on Finance) 
Mileage Car was sold at 44600

On the 13 September i took the car for a service at Mercedes they confirmed the Car has done 102K with 7 pervious history with Mercedes   

I reported it to the Garage where i bought the car from they said its my problem and not there's i sent them a letter for short term reject no response 

My Finance was through a broker contacted them as i want to do a short Term to reject and the Finance company has said we are waiting for the brokers decision 

Evidence which i have 

Pervious adverts from Auto Trader showing the mileage at 102k 
Mercedes Cloud service history 
independent vehicle assment ( they didnt confirm 102k miles they said its higher than whats displayed. 
Mercedes Plausibility check which shows IMPLAUSIBLE 
also Mercedes connected to the via Diagnostic Machine (Xentry) and have found old service info saved on the cars ECU adding to 102k

    The garage is presumably not a Mercedes franchise then, or a main dealer?

    What's the value difference between the mileages?

    So presumably it had a 'haircut' just before it's MOT ?

    Sadly, it looks as though "clocked" is most likely.
    Car is 3 yo.
    Done 102k miles - regular services at Mercedes. 
            When was the last service?
            When was the advert on Autotrader for 102k miles?
    Then, 44k miles on the new speedo without any servicing record...
    Would mean total 148k miles in 3 years (including extended lock-down period).

    Unless there is evidence to the contrary, it may not have been the selling Dealer that did the "clocking"

    And they in turn can start a claim from wherever they got it from?

    I'm not sure on this, on the one hand you mention clocked and then new speedo. I suspect it's more likely the old speedo was reset to a new number so 44k might well be included in the 102k already recorded but not sure how you'd be able to tell that.

    Dealer should have done checks on the mileage if they were a decent one.
    Remember the saying: if it looks too good to be true it almost certainly is.

    Sadly too late for the OP but I'd never buy a used vehicle from a non-main dealer if they wouldn't allow a mileage/fault scan or provide one.

    Most brands can be interrogated by readily available software as read only. 

    Not worth the effort for an old banger but for a few hundred quid and some study/homework it could be worth it for an expensive motor from a dishonest previous owner/seller. 
    Funnily, i've been pondering a small Caddy sized van to facilitate a side project i'm going to work on. I havent seen much movement yet, but in theory markets like pickups and vans are likely to be hit by the upcoming downturn.
    Would be interesting to hear if anyone has direct experience?

    Why? So you can argue with them?
  • A car with 44 k is going to be in a different condition to one that's done 102k regardless of age. Are the seats or steering wheel worn? 34000 miles a year is a fair chunk, especially during a pandemic.
