BW Legal Letter of Claim - help please!

Hello,

I'm looking for some advice:

I've received a letter of claim from BW legal for overstaying the 2 hour period (at an nforce car managed car park) which i paid for a ticket for. I appealed and lost. The company has a photo of my car parked 10 minutes over - they have confirmed there is a ten min grace period so to me the evidence doesn't show I was there any longer than this....advice welcome on this.

So far I have written to the landowner - no response and drafted the following:

to Nforce parking:

Dear Sir or Madam

Subject access request ( Data Protection Act 2018 / General Data Protection Regulations (GDPR) )

Please supply the data about me that I am entitled to under data protection law relating to myself.

- ALL photos taken
- all letters/emails sent and received, including any appeal correspondence earlier
- a PDT machine record from that day, of payments made (VRNs can be partially redacted but insist on getting this; follow it up if they refuse).
- all data held, all evidence they will rely on, and a full copy of the PCN, NTK

If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

and to BW legal:

Dear Sir/Madam,

I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.

I have sent your client a SAR

Yours Faithfully,

anything else to be done at this stage and have i included all i need to?

    Don't offer them more than the legal requirement for ID, a copy of your V5C and the PCN should suffice; absolutely no photo ID such as driving licence or passport.

    Thank you. I need to reword slightly i realised but these 2 are the next best steps yeah? Its all so overwhelming!

    You've come to this forum and that could be construed as seeking debt advice (we've told you there is no debt until a judge says so!) but it isn't necessary to prove it to anyone!
  • Thank you @Le_Kirk, I've went both the SAR request and the 30 day hold. Once all info received time to work on defence, I think I'm on track...

    OK but you are not yet at defence stage without a court claim yet.  Good to prepare though and read the forum's template defence in advance.
