Can i sue Dell?

So i bought a NEW monitor from their UK online store, they only sell new here, no refurbs no 2ndhand stuff.

The monitor comes and has significant backlight bleed so i request a replacement. Even though their site clearly states 24hr replacements it took 10 days to get it swapped...

2nd monitor arrived and had a chips out the panel and was covered in cleaning wipe marks all over the screen... clearly not new at all!

So again i contact them and ask why they sent me a refurb and send them pictures kf the issues...they say sorry and offer me a 3rd replacement. I accept but refuse to wait another 10 days! They agree and ship the 3rd replacement asap... due to a weekend it was 5 days altogether.

The 3rd replacement has arrived today and again has a damaged box and is clearly not brand new... i havent inspected the monitor yet but theres noway a new monitor would have a box like this!

If the actual monitor is fine ill keep it but if once again this is a refurb can i sue Dell for messing me around and trying to swindle me with refurbs? They are a world wide company yet try to sell people refurbished items as new!

Some help on this please as its crazy what they are trying to do here...

It may be easier to return it, get your money back and buy in person from PC World or similar, unless you have actual losses that are covered by your contract, as I assume you'd only have losses if you were in business and therefore not covered by consumer rights protections.

No. You're entitled to get either what you paid for, or a refund.

Just return it for a refund and buy elsewhere.  No need to sue them, you're entitled to a refund.

Thats what ill do if the 3rd is damaged ill refund but im pretty sure they are not allowed to sell refurbs as new? I dont see how they think they can get away with this.

I bet loads of people are ripped off by these!

No you don't sue them.  You request a full refund as the goods are not as advertised.  Court action should always only be a final resort if nothing else works.

Yeh, return it for a full refund and then report them to Trading Standards because that will help other people - you can easily do that online via Citizens Advice -

    https://www.citizensadvice.org.uk/consumer/get-more-help/report-to-trading-standards/

They say, "to report to Trading Standards, you need to contact the Citizens Advice consumer service" and then they give the link for you on that site. So easy. Hopefully!

Then buy 'properly' new from a reliable retailer.

I've purchased plenty of Dell items over the years with no problem so I would be happy to say they are a 'reliable' retailer.
Indeed, I'm not sure which PC manufacturers you'd think are more reputable.
