Dcbl letter before claim stage

First hearing is a video link. I have attached their pictures and evidence, doesn’t look good for me what’s your thoughts? Their sign here seems ok.Coupon-mad said:i will end up paying more even without the added costs as the two days lost in wages for each claim will equal to another £500 lossWhat 2 days?
Is the first hearing in person or by phone/CVP/Teams?
You are not having to attend two hearings, just an hour for one hearing. You may well win due to UKPC's terrible signs.
If you win, you get to ask for your loss of leave/earnings at the end of the hearing.
As I said, the second one is likely killed off by a robust email about 'cause of action estoppel' when the first one is resolved.
Either you will have lost the first one, and can then make an offer re the second OR you will have won the first one, and can tell them to get lost and to discontinue the hopeless (duplicate facts & equally crappy signs) second claim.
The 'legal advice' you got was clueless generic knee-jerk presumption. Over the phone, how the heck can they have looked at the signage and formed the opinion that the Claimant has a case to win?!
Have you emailed the SAR as I said to do first? Now, this afternoon? Or have you already got a SAR and know what their evidence photos look like?
"I am running out of time to file my WS for this claim now I am unsure what else to include after being told it’s not going to be good enough."Who said? Forget the bad legal advice.
What's your deadline?
Latest good example WS was yesterday by @aphex007

Easy to copy and adapt. Goodness me, this is a claim from UKPC and NO-ONE here would offer to settle because we know what their signs are like!0 -
The sign is appalling. Can you read the £100?on the phone yesterday the guy from dcb said I had 7 days to settle and in the email today the other guy is saying by end of today. But you won't be settling. Your solicitor is hopelessly wrong. You may as well fight it and see if you can win the first one, ask for your loss of leave and then tell them to 'do one' re the second claim.
Even if you lose you don't pay the £70 add-ons per PCN, as we told you, as long as you know how to argue that properly. You do need to prepare a decent WS and evidence.
What's your WS and evidence filing/serving deadline...on the hearing letter?
You won't lose £500 for taking one hour by Teams, for the first hearing. That's like a dentist appointment - just a lunch break.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The deadline is in 13 days time. I’m just not sure where to start regarding evidence and my defence, other than the sign not being good enough? Would they not say the sign is clear and big enough to see though and it states no parking. I will look to use the WS you linked to me, will obviously need to adapt some things to suit- which is where I’m unsure where to start and what to say really, hence the panic of thinking of settling.Coupon-mad said:The sign is appalling. But I told you which WS examples to copy from. Did you look? They are all about unclear signs and they show you the whole bundle including what sort of evidence and case law to append.
It's already done for you to copy. It is sooooo easy.
Remind us why you parked there, why you thought you were not 'unauthorised'? Did you say this is a gym car park and you were a patron?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Looking at the sign it does state about an additional charge if not paid.Coupon-mad said:But I told you which WS examples to copy from. Did you look? They are all about unclear signs and they show you the whole bundle including what sort of evidence and case law to append.

it is a car park around the back of some shops, barber shop, estate agent and I’m sure it says for use of house of fisher customers only or permit holders. Thinking about it I probably used it to use the gym which is just across the road from it.0 -
Looking at the sign it does state about an additional charge if not paid.Which their crappy small print signs always do.
Have you seen how often we see UKPC lose here?
Have you seen what the DLUHC said about these added false 'costs' in the new Code of Practice Ministerial Foreword in February?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Cp100 I know it seems dauting at first to make a start on the WS Bundle but once you choose a "best suited template" from the forum and make a start on it and start adding/removing/customising parts that are more relevant to your circumstances I think you will gain inspiration!
I've not had time read your previous pages yet! but have you tried "Google back in time with Street view" yet, to check for more photo evidence for your WS Bundle? https://blog.google/products/maps/go-back-in-time-with-street-view/

I hope you don't mean defence as you have already submitted that weeks/months ago, except that your witness statement supports your defence.Cp100 said:The deadline is in 13 days time. I’m just not sure where to start regarding evidence and my defence, other than the sign not being good enough?1 -
No I just mean defence as in why I shouldn’t be liable for these charges even at the original amount. aphex007 said:Le_Kirk said:

I have not seen how much they lose I just didn’t think I had a chance as the sign states you can’t park there.Coupon-mad said:Looking at the sign it does state about an additional charge if not paid.Which their crappy small print signs always do.

No I just mean defenceYou don't. You've already written a defence.as the sign states you can’t park there. It doesn't.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
