Parking Ticket Threats

I think this may have been covered several times before so please forgive me.

My wife is an A&E doctor and has been receiving letters like the one I have attached for a few weeks now. She received the tickets earlier this year during the lockdowns when the hospital had to issue parking permits to temporary staff to cover hospital staff who were either ill or isolating. She had been informally told by the hospital that the tickets would be sorted out. She would always try and park in the allocated spaces but it got to a point that she was going to be late for her shift - something she cant afford to do as they have crucial handover meetings at the start of the shift.

I just want to double check that the advice here is to ignore these? It won't affect her credit rating and she won't end up in court being chased for thousands?

Debt collectors are powerless and can safely be ignored. This is explained in the sticky Announcement for NEWBIES that asks everyone to read it first.

You should complain to the head of the hospital trust, your union rep if you are a member, your MP, the Secretary of State for Health, as well as local and national press.

You should also have a look at the government guidelines for patients and staff at NHS facilities and point out to all of the above how the actions of unregulated parking companies and the landowners who employed them are breaching this government mandate.

NHS car parking guidance 2021 for NHS trusts and NHS foundation trusts - GOV.UK (www.gov.uk)

    One final thing.

Thank You for the work you do.

Please DO make the complaints as suggested. CP Plus do take people to court, and it's easier to stop it now than later once a court claim has arrived.

You owe nothing unless a judge says so.

They have added what appears to be an extra unlawful amount for debt collection. Judges have dismissed an entire claim because this. Read this and complain to your MP.

    Excel v Wilkinson

At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

Has she complained to her MP?

We can’t promise she won’t be sued because parking firms DO sue doctors and nurses mercilessly.

she needs to get her MP to write to the hospital and parking firm bosses and insist this trash is cancelled.  Or you could contact your MP on her behalf.  Insist on pressure being put on all parties to stop this utter extortion.

It is important to get them cancelled because whilst you can ignore debt demands like DRP and Zenith toilet roll, you can’t ignore a court claim and if she has multiple unfair PCNs she is more likely to see it passed to an aggressive roboclaim solicitor.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • She has 6 of these, totalling £900.

Are you saying there is a chance this could get to court??
