    It's now what you said, What powers do you think they have relevant to the offences you ca Liam they dealt with or how do you think it would help the OP? The "police" who attended clearly weren't interested in dealing with any criminal offences.

    I know. I missed out  "some of", just like you made mistakes with your post ^ no-one's perfect, are they? PCSOs are more than capable of warning people to not take things further which is what the OP seems to want to happen, just as I did in my own situation. I read from the OP that the police would investigate if a crime actually happened (the criminal offence of cutting the pipe), so yes they were interested. 
    I have no idea why you wish to derail this thread with petty point scoring.  I have no interest in arguing with you over something and nothing.

    A crime has actually happened, threats to commit criminal damage. That's a bit beyond a warning from a PCSO.

    We had to have the shared septic tank emptied three times in a year and realised something was wrong with the drainage field.  The neighbour swore blind he couldn't have done anything to the soakaway, which was on 'his land', and he wouldn't let us investigate.  We had to go to a solicitor in the end who instructed him to allow someone to 'hand dig' around the pipe without disturbing his drive - and as we thought, it revealed the cracked pipe, caused by his trades when they laid his gravel.  I had to declare the dispute when I sold, but the neighbour has since sold and hopefully the new owner will be more 'neighbourly'.

    Ok further update. The insurers have said we are not covered because their letter was dated before the 90 days after I took the policy out. So if they send a solicitors letter what do we do. We have no money for a lawyer can we defend ourselves in court.

    Of course you can although you would need to do a lot of prior research and preparation.

    Some solicitors offer a free 30 minute consultation. That might be enough to help you.

    Post again if and when you get a solicitor's letter. They may be bluffing.

    I'm fairly sure that they are bluffing.

    You say that you have a Prescriptive Easement https://www.adams-harrison.co.uk/prescriptive-easements-what-are-they/ so that should give you all the rights you need.

    Hi thank you for the link. Do I take out indemnity insurance or does the person who buys my house? And do I need to go to a solicitor now to make a statutory declaration or statement of truth ? How does it all work ?  We have lived in the house since 1986 I believe the septic tank pipes have been on the neighbours land since the house was built 1930. We have replaced the pipe in 1993 because it collapsed . We did this without informing the owner , Just went on the land and replaced it. We then repaired again in 2010. We do all the repairs and maintenance with our money. The previous owner of the land was a friend and he was aware we were maintaining the pipe but just left us to it.

    I'm no legal expert so can't advise on insurance or legal representation.

    In our deeds, it says we have permission to enter neighbours land for maintenance works but must give 24 hours notice.
    What do your deeds say

    I still suspect the new folks are calling your bluff and hope that when you say <<The enviromental health man came up said he was aware of the pipe on their records and that it conformed with the new 2020 regulations and put some dye down it. He came back the next day and checked the outlet and said it was dry as a bone and perfectly ok>> you have the upper hand
