Hi all - something of an update for you... and sincerest thanks for the fantastic service that you all provide and contribute to (will that ever be boring for you to read!?)
I've had a response from the court - in what I'd imagine is a typically unclear format, and I read down towards the end to see what I had to do next and with a particular focus on any dates that were mentioned.
More fool me, because after my initial grumbling about it being dragged out (the date for me to do something was in March!) I then set to work focussing on the "preamble", which read:
IT IS ORDERED THAT
1.The Particulars of Claim do not comply with CPR 16.4(1)(a) and are by this Order struck out
It does go on to say that the claimant must serve particulars and a statement of truth, but does this mean it is pretty much over and done with?
I want to be happy, but feel there is still a glimmer that they can still pursue...?2 -
Not over I'm afraid!
Excel are most likely to comply and send new Particulars.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Boo

Hey ho. March it is then.
The letter isn't very clear whether the claimant will send me a copy of the particulars in Feb?0 -
If this is one of these old claims that they have pulled out of the woodwork then they must have thought that there was not much mileage as they are a very litigious company. If they believed that there was any merit in the claim they would have been after the keeper like a rat up a drainpipe.longtale_Parker said:Boo

They could pull at the last minute. This has happened with these old cases.

Does the order give you the right to amend your defence if the Claimant sends new POC?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They have continued to ignore my subject access request. I'll get back on to them about that while I'm waiting...

The PPC's signage on entry is non existent. The museums sign says parking charges apply but that is on the side and I doubt that anyone would read that whilst driving. Most of these historic claims have been a try on.longtale_Parker said:They have continued to ignore my subject access request. I'll get back on to them about that while I'm waiting...

If they arer breaking the SAR regulations complain to the ICO.You never know how far you can go until you go too far.1

Thanks again!
I believe that Excel have now lost the contract at the museum and I think NCP are managing it now.
I will also complain to the ICO regarding the failure to comply with SAR
