    Whatever letter it is from the court (if not then the next one) will include instructions about filing and serving your WS and evidence.  Usually on page 2.
    As above, I posted this in March.  It is in one or the other.

  • hi All, Ive got my hearing date - (20/9/22).however I am a little confused as to where do i send the Witness statement over.

    I have emailed all documents to an enquiries county court email. and i have sent my number to the remote hearings email address. Do i send my Witness statement to the remote hearings email address too? and do I need to send excel's legal team my witness statement? (I have received theirs)

    Your best bet is to phone the county court which is organising the hearing.

    Anything anyone posts here will only be a guess on how your particular court wants to manage things.

    Don't miss the deadline for filing your Witness Statement and evidence. The deadline must be very close.

    Did the directions say you had to send the documents you rely upon earlier than the WS, then?  That's what you seem to be saying.

  • Managed to speak to the enquiries line today and got some verification. do we need to email our witness statement over to the claimant's legal representative ? I couldn't find any details on the court paperwork. the person on the phone suggested me to email and ask the court- but i doubt they would reply?

    Please clarify why you say you've already sent documents, but not the WS yet?

    The order is clear as long as you know what the terminology means, or Google it.

    It says 'file and serve' which means 'file' to the local court and 'serve' to the C's solicitor.

    Both can be by email these days.

  • Thanks for clarifying! Sorry it was so silly of me - I found the bit where I am supposed to email the other party also.(each party must deliver to the other party and to the court office copies of all documents on which that party intends to rely at the hearing no later than fourteen days before the hearing).  However today is less than 14 days ( 13 days - including the 20th- the hearing date  ). Am I in deep trouble ? The WS was emailed to the court yesterday (14days including the 20th).

    Just send it asap, the judge will either allow it or not.  Do not mention it is late, just send!

    already sent it yesterday. It was the 14th day count backwards inclusive on the hearing date though. however I just sent the WS to the other party today (13th day)- hope its ok. *fingerscross*

    I wouldn't worry about a day.  YOu can say if they raise it, that the Claimant has clearly not been disadvantaged.

    The WS was a full and detailed submission attaching evidence, as seen in other threads?  

    e.g. based on the bundle by @Daiapolon2021 or @aphex007 I hope, including Excel v Wilkinson and other exhibits?

    And you included your costs schedule?  If not that can even be sent next week as there is no deadline for a costs schedule.
