  • Thanks KeithP!

    I haven't received any documentations from either the claimant/ solicitor yet - I have just chase the solicitor via email for the CRP 31 request. Should I be chasing excel parking for the SAR too?

    Why are you using CPR 31?

    Do the SAR to Excel, calm down and read the 2nd post of the NEWBIES thread and the template defence thread, and then read ten or more claim/ defence threads here.  No searching, just click on thread titles and find the most recent ten or a dozen, and read them and see what other people have done.

    Copy what they did.

    someone on the other forum has advised me to send a CPR 31.14 to the solicitors and SAR to excel.

    Oh god.  This is a small claim, so you always need to cross-reference the rules specific to those claims.

    Extent to which other Parts apply

    27.2

    (1) The following Parts of these Rules do not apply to small claims –

    (a) Part 25 (interim remedies) except as it relates to interim injunctions(GL);

    (b) Part 31 (disclosure and inspection);

    I agree with you @Johnersh, but the theory expounded over on Pepipoo is that this case isn't on any track, Small Claims or otherwise, at the moment.
  • well lucky I also posted a SAR to the legal firm. However they still not replied - so I have send them a follow up email today to chase.

    I guess I should be doing the same for the excel parking too?

    You didn’t want a SAR from the solicitor anyway.

    Anyone has a calendar month (30 days) to respond to a SAR.  If you do not receive your data by then, complain to the ICO.  As @Coupon-mad writes, the legal types won't have anything worth sending to you that the PPC don't have.
  • would it make my defence weaker if I don't get the documents from SAR in time ?
