Parking fine for parking in an electric charging bay

I was fined £60 for parking in an electric charging bay in Lakeside although it didn't look as though it was working and there were no notices to say you could not park if you did not have an electric car. 

I have appealed but they rejected my reasons and said the following:

Whilst we note your comments & reason for appeal, we can confirm that your vehicle was parked in an Electric Car Bay without being charged. Therefore, as your vehicle was parked in contravention of the terms and conditions as advertised on the signage displayed on site, this PCN has been issued to you correctly.

 

You have now reached the end of our internal appeals procedure and therefore you now have two options; you can either pay or appeal to POPLA - you cannot do both:

Should I just pay up? I didn't even realise that they gave fines in Lakeside shopping park.

    Depends on the signs and markings , landowner contract , circumstances , etc

    Given that these bays are a new phenomenon , I would expect that they are clearly marked

    It would be foolish to park in one unless the driver was charging the vehicle , so I cannot see a win here , working or not is irrelevant

    Are there any signs there stating that non-electric vehicles cannot park in an electric charging bay?
    Or perhaps they say something like electric vehicles only?

    You need lots of pictures.

    If, as you say, there are no signs indicating that 'rule', then how can you have broken that 'rule'?
  • There was just a notice telling you how it worked. I looked all around before leaving the car too.

    It was premier park ltd. Also £60 a bi excessive no signage anywhere stating that you would be fined for improper use at all.

    It will be £100 , not £60 , it's reduced by 40% for early payment , otherwise it resets back to £100

    Although you feel that it's excessive , it's the standard £100 for a decade and won't change until next summer , so due to the Barry Beavis case in the Supreme court in 2015 , it's not a winning argument and hasn't been for 6 years

    To win this you would need good pictures showing poor signage , plus the words on the signage are also very important

    And did the signs say that being parked in an EV bay without charging results on a Parking charge?

    And obviously you don’t pay up, see the 3rd post of the NEWBIES thread all about POPLA.

    It's an invoice , not a fine ! Any signs would say Parking charge notice , or PCN , same as the postal NTK PCN they issued to the keeper

    Any liability is totally dependent on the signs , or lack of
