  • Ok. Thanks. I'll remove the PCM v Bull one for now then. Do I remember reading in a VCS thread somewhere that they sometimes withdraw the claim following submission of a robust Defence?

    I don't have a scanner. I have a digital copy of our signatures which I put on forms and pdf them as an image (equivalent to scan file). It's always been fine for everything I've ever done before, is there any specific reason not to do this here?

    And I then just email it as per the thread, without doing anything on MoneyClaim or otherwise drawing attention to the fact that I have submitted my defence?

    Digital signatures are absolutely fine , no problems

    Correct , just email the defence pdf to the ccbcaq email address and add in the claimants legal company if used , or claimant if not , so both receive it , after 9am and before 4pm , on a weekday , checking for email auto receipts

    Nothing to do on MCOL except checking progress in your claim history
  • Thanks, that's done. It feels strange sending them an email without being invited to defend that way, but of course I have every faith that you know the best procedure! Will we receive a confirmation that the defence has been received and applied to the claim on time?

    In the meantime, should I send VCS an SAR, since I haven't done that yet?

    we do, and the defence template post tells you too !!

    check your email inbox and spam folder for an email auto receipt, which should have come back ( but recently quite a few have failed , especiall when they are not open ) between 9 and 4 on a weekday is best, checking for the auto receipt , plus checking your MCOL claim history to make sure that the CCBC have logged it

    of course you should be emailing a SAR, goes without question !!  its a given that you do so, it always is
  • We got an automated response straight away after with the subject line "AUTO RESPONSE DO NOT REPLY - CCBC AQ Acknowledgment CA". The body had nothing relevant, just a COVID update and some other generic information.

    We've logged into MCOL and can see:

    Your defence was received on 27/09/2021

    DQ sent to you on 27/09/2021

    So it looks like it was ok. I suppose the Directions Questionnaire will arrive in the post.

    Sometime after the CCBC has copied your defence to the claimant and they have confirmed they wish to proceed. The claimant has 28 days in which to do so. Keep an eye on your MCOL history to stay ahead of the curve!
