  • I just read about a few cases (e.g.) where people had successful counter-claims based on the distress caused following unlawful access to the DVLA database, i.e. pulling keeper details in breach of the data protection act. Then the first reply also suggested counter-claiming. It seems like having the threat of a significant counter-claim might put PPCs off improperly using the DVLA database in the fist place. But it wasn't what I came on here for so let's forget the counter-claim and I'll just focus on a robust defence.

  • Well they have accessed it in breach of their KADOE (Keeper at Date of Event) contract with the DVLA.

    The contract states that they may only access the DVLA database to pursue the keeper if PoFA 2012 applies (it does not and they know this) and if they are accordance with the Accredited Trade Association Code of Practice. They violate their Code of Practice by ignoring the mandatory grace periods by pursuing 'no stopping' cases.

    No, the DVLA told PPCs that they can still get DVLA data even if they don’t bother with the POFA.  It’s lawful in order to ask who was driving.

  • Ok. Well like I said, the idea of a counter claim isn't why I am here. 

    Does anyone have ideas for how to get signage photos without going to Bristol!? I believe street view imagery isn't up to date.

    I got your message. I'll send you what I have from my recon mission earlier this year. I have dashcam video from the airport entrance to the drop-off car park so hopefully it will include the signs you want to see.
    The only stills I have are around the drop-off car park only.
    I also have a copy of the contract between VCS and Bristol Airport Ltd provided by another poster. The landowner is a Canadian teacher's pension company, but they never replied to my relative's complaint.

    The airport weren't interested, but that shouldn't stop you from complaining to them.

    Misuse of personal date might e an avenue to explore.  
    You never know how far you can go until you go too far.

     That's great to know, many thanks. I have been going through this now. The online form states:
    You can choose to contest jurisdiction of the claim made against you.
    I was wondering if the answer to this should be 'Yes', as being a byelaw site, it should arguably be heard in the magistrates. Or is it still 'No'?
