Phew just off the phone with them, they said it all looks fine on their end, they got the defence ok and no default judgement. They said if it was too late it would show up on their system, and said its possibly cos it was a bank holiday and it carried over. Also MCOL is working now with an updated history
So stress relieved for now 😅, just want thank everyone, you do an amazing job helping others, i honestly would be totally lost without you guys3 -
*UPDATE*
So today was finally my court hearing, I was nervous as hell when I arrived, but the 3hrs delay allowed me to calm my nerves and just wanted it to be over with by the end.
I did very little talking actually, mostly it was the judge and claimant solicitor, the judge might ask me a question later. I knew fairly early on that I was going to win, as the claimant solicitor was arguing the points the judge would counter most of them. It helped that the claimant couldn't get a lot of facts right, the car park is a public car park for shops that leads to a gated residential car park and he was saying i parked at the residential part which is impossible to have access to without a pin code to open gates. He was saying if i parked at the shop public parking (which i did) it would've been free, but actually it isn't free anymore that was the whole point, they changed it 2 months prior to 30min free if u print out a ticket from the machine. So basically the claimant was confused about the facts and didn't know what he was really arguing about really. Saying i got photographed at the residential area entrance but actually it was the main road entrance, even the judge could see the photos didn't really match up to where he was saying.
second point was the signage, judge agreed with me that it was very poorly signed, and there was very little lighting and no proper signage at the entrance of car park
The whole thing last 20-30 min and in the end i was awarded £50, i wanted more but its better than nothing i guess
Whole ordeal before that was stressful as hell and half way through writing the defence and witness statement i was wishing I'd just paid for it at the start to save me all the time and stress. But I'm glad to have gone through it, at least i have the experience now and the court isn't as scary as i thought it would be, the judge and claimant solicitor were actually very nice, also feels damn good to have won!

ANOTHER BANK PARK / DCBLEGAL ONE BITES THE DUST!
Now you've won this battle and earned the 'virtual t-shirt', please don't disappear just yet.
A final Public Consultation is coming.
We need you; motorists need you to help us make a difference forever. What a waste of your time this was, and why should there be such a litigation culture in parking? It's truly horrible being pursued for £100 plus false 'fees' for no reason, by an ex-clamper aggressive firm, isn't it?Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture.
There will be one window of opportunity later this year. My best guess is in October.
Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.
If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:https://forums.moneysavingexpert.com/discussion/6333989/mse-parking-ticket-appeals-guide-feedback#latest
Read the latest posts there.
The PPC money-grabbers have blocked the new Code by filing for Judicial Reviews. Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.
It's on hold. Motorists urgently need it reinstated and the ban on false 'DRA fees' confirmed, to stop the rot.
This year will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.
We need high numbers of real victims to make a point of responding to this final Consultation.

Funny thing i just remembered, on the way down on the elevator the claimant solicitor says to me "we've lost so many cases on this fxxxking car park" (his exact words lol)Misattributed to Einstein, but holds good for this shower!
