BPA Continuing to Whinge about Reduced Parking Charge Levels

Latest throwing of toys out of pram, from the BPA website: https://www.britishparking-media.co.uk/news/proposed-cap-on-pcns-for-parking-on-private-land-a-real-concern-says-bpaThis is the same BPA who, in the leadup to POFA 2012, told the Government that the number of parking-related court claims was 'between 2% and 5% of tickets issued', which equated to between 36,000 and 90,000 claims annually. A subsequent FOI request to the MoJ, revealed that in 2011 there were just 845 claims issued, of which only 49 ended up in court hearings.
Clearly, the BPA cannot be believed or trusted, and the numbers in their latest puff piece appear to be more made-up fantasy figures.
They suggest that most PCNs are issued to 'selfish motorists', whereas the reality is that the vast majority are issued to people going about their everyday lawful business, and fall foul of unexpected checkout delays, mis-keyed VRMs, unclear signage and bay markings, slipped permits, pay machines not working, and many other reasons.
If the new statutory Code of Practice, and charge levels in line with Local Authority penalties, causes some operators to go to the wall, and to have to lay off staff, that will be no bad thing - it will mean that only the efficient companies will survive, and they will have to actively manage parking instead of chasing excessive profits and vast director salaries.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

The national economy as a whole could be hit by the changes to parking charges, with at least £65million worth of parking tariffs estimated to be lost yearly if the plans were implemented.Leaving £65million in motorists' pockets to spend in the local economy in exchange for goods they desire, not coerced into handing it over to PPCs to fund yachts, Aston Martins and personal helicopters!Another casualty of the charges could be the NHS, as £900,000 worth of parking revenue could be lost to “tariff theft” in just 121 NHS car parks. The Scottish and Welsh NHS don't seem to be doing too badly in providing free parking! This unprecedented blow to the sector is projected to see 3,000 jobs lost.Plenty of job opportunities post-Brexit - the daily news is full of the current labour market employee shortages. It will give PPC redundant workers the opportunity to find jobs useful to UK Plc and to get off the minimum wage bottom rung of the pay ladder. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

ParkingEye has produced an Impact Assessment ?
No doubt very biased to suit themselves
The data shows that the effect of reducing the PCN cap from £100 to £50 will at least increase non-compliant parking two-fold and therefore double the number of PCN’s issued across the country. ?
You could not make this up, someone has though
In smaller car parks that are not well managed, 82 percent of spaces are misused by motorists, who are not deterred by low parking charges. ?
Assuming these smaller car parks are members of the BPA, why are they badly managed ? Is it because the BPA do not audit them with poor and hidden signage ? 82% misused by motorists ....
Again, You could not make this up, someone has though
Furthermore, these proposals will result in up to two thirds of operators having to cease trading within two years and thousands of job losse ?
This is just propaganda, are they classing ANPR as a job v a warden. Most car parks are automated now. And if an operator ceases trading there is always one of the big boys to take over.
Maybe the BPA mean that their own income will fall by two thirds ?
Many businesses will also be affected as they will need to consider implementing or increasing tariffs for parking.?
HARDLY, in the case of retail parks who are now desperate for customers to support their retailers,
Take out the "joker" card of the parking company and business will increase.
Faced with these losses, 46 percent (33 operators) are set to become insolvent within the year, reaching 67 percent (44 operators) the following year. ?
This unprecedented blow to the sector is projected to see 3,000 jobs lost.
That is MINISCULE compared with the damge covid has done.
It's not unprecedented, it's been coming for years ever since the DfT were duped
when lockdown eased where anecdotally motorists were heard to say ‘£35? issue me a PCN then?
Are these car parks linked to microphones now ?
Another casualty of the charges could be the NHS, as £900,000 worth of parking revenue could be lost to “tariff theft” in just 121 NHS car parks. ?
What a disgrace that the BPA think the patients and medical staff should be punished
Effective parking management is necessary to deal with selfish and antisocial behaviour and allow us all to safely complete our daily journeys. ?
The word effective is not the same spelling as the word scam.
Where does safely complete our daily journeys come from ... it's nothing to do with effective parking management ?
The BPA should take note of motorway signs that say "tiredness kills, take a break"
THAT'S WHAT IS CALLED SAFELY
It's because of this terrible attitude that the new code of practice came about.
And PS: ..... Everyone knows these are not FINES, the BPA think they are ?

"Separate data commissioned by the BPA, also found that parking operators are expected to lose 40 percent of their income should the Government reduce penalties."
The BPA admit these charges are penalties then.
"Effective parking management is necessary to deal with selfish and antisocial behaviour and allow us all to safely complete our daily journeys."
I'm assuming the BPA are referring to the parking industry.
I note that there are no surveys or comments about the benefits to Joe and Joanne public.

The irony of it made me smile. 😁Jenni x2 -
The BPA should consider what will happen if the charges (their profit) were reduced to zero because no one could afford to park anywhere any more. Will they still claim they are driving up standards or will they have to claim they are driving PPCs out of business? Another possibility is that drivers adhere to the "made-up" rules and nobody parks out of a (badly drawn) bay (or this that a pop group), never fails to pay and display a ticket or a permit and never overstays, there are no fluttering tickets and ANPR is synchronised with PDTs. Wow, immediate loss of revenue and profit.3

YES .... I sent the link to that BPA article to many today, asking for their comments.
The overwhelming response was ....... "no wonder BPA members are scared with a leader like this".
