Unlikely to be heard this side of Christmas. Depending on how busy the selected court is, substitute Easter for Christmas!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I haven't heard anything since CCBC confirmed receipt of my defence mid September. Is it safe to assume that the claimant is not proceeding with their claim?

No, that is not a safe assumption.

Have you checked your MCOL Claim History recently?
It's only a few lines long - perhaps post the content here.

Nothing untoward there - except for the lack of further progress.

You might want to ask the CCBC what's going on, but they are closed now until next Wednesday.

And if you move house at any point, tell the court and solicitor as this case could be resurrected at any time behind your back if you don't receive the DQ.

Best thing is to ask the CCBC if it is 'stayed' due to no action by the claimant.  That does NOT mean it's over.  Just frozen.

Hello all. Over a year later and I have received an update.

As a recap. An N1 claim was issued 13.08.2021 for a PCN that was issued 04.12. However, the picture of the PCN provided from the SAR shows that the PCN was dated 12.04.

An AOS was submitted 30.08.2021. Defence sent and received 13.09.2021.

I have received an N180 directions questionnaire dated 01.11.2022 (nearly 14 months after defence was received).

Is this untoward? Should I be completing the directions questionnaire and pressing ahead?

Thanks in advance for any help.

If it was sent to you by H.M.Courts Service, then yes you should.

Like we already told you last year, this could be resurrected and it has been, so you must continue as per the advice on this forum.

    Now read:

    - the first 12 steps set out clearly in the first post of the Template Defence thread

    - the thread from June by @Grizebeck about the new question in the DQ

    - the section in the NEWBIES thread headed in RED capitals:  IMPORTANT: KNOW WHAT HAPPENS WHEN.
