Exactly what I did. Told him we’d pay his days money as a goodwill gesture leaving us out of pocket whilst we investigate further. I told him that was a close to the mattervisidigi said:TWIGLET1234 said:
Coooooor he ain't got a hope. Tell him you consider the matter settled (based on goodwill as opposed to evidence he was there).
He actually left voluntarily on the day he received the pay he’s questioning and giving the reason of departure as his money being wrong. His supervisor told him not to be so hasty and that we’d get it sorted the following week. He still decided to quit.Westin said:I’d call his bluff. Sounds like you have been more than reasonable.
I doubt he will follow through. Even more doubtful on his success of the £1000 claim if he did.
Assume he will on longer feature on your approved sub-contractor work list.We would have given him continuous work for the foreseeable which is why it’s even more galling that he’s trying to claim £1000 for financial worries.
The court wont take kindly to his refusal to prove he was there and his flippant amount claims.
He said the matter is far from closed and he will be making his claim Monday. He clearly has wanted to profit from the situation from the get go.0 -
Please come back and let us know that he was all mouth and no trousers.TWIGLET1234 said:

@Jenni_D I will do. But something tells me he truly believes he has a strong case and he has told me we will be liable for fees (he obviously doesn’t realise that’s only if he wins). Part of me wants him to go ahead, just so it proves him wrong and costs him a stack of money more0

Don't forget to counterclaim for all the costs and staff time for defending his ridiculous claim.
If it sticks, force it.
If it breaks, well it wasn't working right anyway.1 -
I would certainly counterclaim that you gave him a full days wages as a good will gesture but as he only worked X hours that day you are claiming the extra back! Plus having to advertise for someone else as he let you down?!!
He has no chance of getting the £1000. If he does make a court claim he is an idiot! He walked out of a job that would have given him decent future earnings and he claims for stress?! that makes no sense at all!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

Personally I don't mind that Twiglet posted on here but might get more useful help on the small business board perhaps.0

If you made a mistake, you rectified it in reasonable time (in this case without even verifying his claim was correct) and it was for 1 day of work.Check whether he did work that disputed day (do it by email) and use the evidence that you paid out on his claim before investigating to show you were not unreasonable in your behaviour. It sounds like this chap has unrealistic expectations or has tried it on before elsewhere. The daft thing is that in some industries which rely on subcontractors, such behaviour does get noticed and word of mouth gets around. Whether he had a claim in the first place or not becomes irrelevant as other firms decide he is not worth the hassle (I worked in an industry using a lot of subcontracted labour).May you find your sister soon Helli.
