Post this back in March 2020 - just got County court claim form (I know i got it wrong last time !)

    Hi keep checking MCOL website and still just showing Your defence was received on 31/08/2021, will this be update once past the 28 days ?

    Thanks Keith but how long do you think i have to wait, will they change status at some point if it goes over 28 days

    Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.
    If it takes, say, another month then perhaps you should ask the CCBC what's going on.

    I think you do need to consider that possibility.
    Keep all your documentation for six years.

    Of course they can object to the Court's decision.
    Whether that objection will be accepted remains to be seen.
    What we don't appear to know is how justified the Court are in making that decision.
    For example, has the Court stayed the claim because the Claimant has failed to respond in some way, or has the Claimant responded correctly but the Court not noticed that? Who knows?

    No you won't get a warning and the 6 years runs from the date of PCN.  So, if you move house, tell the court and Claimant/solicitor, to avoid missing a Directions Questionnaire which can arrive out of the blue, years later.  Terrible, isn't it?  You must make sure you see any letter and that's all you need to worry about. 

    KEEP ALL THE PAPERWORK AND THE DEFENCE YOU SUBMITTED.
