I have also referenced the Supreme Court ruling
"The main reason for the £85 charge was to meet the costs of enforcing the parking rules"
And that after the ruling, both ATA's inflated the charge to £100
ALSO ...
1: Debt collectors employed by PPC's must be regulated by the FCA and comply with the rules. Only regulated debt collectors can be involved
2: As the debt collector offers a "no win no fee" service, if the debt collector fails, there is no fee to the PPC. If thereafter the PPC who is the owner of the debt instructs a legal firm and adds an amount they never paid then the PPC must prove they paid a debt collector.
3: Debt collectors can only chase the original debt being the parking charge
4: As per current rules, a debt collector cannot purchsse a debt from a PPC7 -
There is also the question of when the debt actually becomes a debt. It should only be a debt after a court judgement.
I think that debt collection may start after the single appeals service. If that is much fairer the pipeline of claims will be greatly reduced so there will be less need for debt collection.
What seems to be very misunderstood is that for many motorists receiving PCN's it is not a matter of affordability it is the principle so debt collection is futile.

And the DVLA failing to update all database addresses of people when they know the data is wrong, is a DPA breach shocker that must end. They know the wrong data is being given out to Police, LAs and shedloads of PPCs.The DVLA have almost certainly caused tens of thousands of CCJs, by this data processing breach. I hope that the Single Appeals Service is staffed by adjudicators with a legal background that are truly independent and can make judgmental decisions rather than criteria based. Mitigating circumstances need to be taken into account.

Can I suggest that the title of this thread is modified in such a way to encourage people to bookmark the thread to help people to see new ideas to consider for the consultation. In that way the dialogue will keep it in the mind of posters. Please bookmark this thread in the title is my suggestion.5

It would be interesting to hear people's thoughts on when the discount period should finish. In my opinion motorists should be allowed a fair independent appeal before they lose their discount.
We all know that the first appeal to the PPC will automatically be rejected so what is really the point of appealing. The only thing is that if the motorist does not appeal the PPC will use it against them if the claim reaches the court stage.
There are also many examples of gross unfairness that can be quoted. There is one particular scenario that particularly affected me and I may try to contact this person and ask them to comment.
Norma's case was extremely unfair as is sadwithoutmynelson's case.
