    And as I said twice, you don’t even need that because Smart don’t use the POFA anyway.  
    Sorry to be dim. What do you mean by Smart Parking don't use the POFA?

    As Smart's Notice to Keeper doesn't conform to the strict requirements of POFA needed to transfer any driver's liability to the keeper, there is no possibility of a keeper being held to account for anything the driver may have done.

    Been ill for a couple of weeks but had some good news during that time. The PCN has been withdrawn with the reason given to POPLA as the "client" did not wish to proceed. Whether it was my service request with Mon CC asking them to drop the PCN or the fact that I wanted to see the contract in my POPLA appeal I do not know although Mon CC did not respond to my Service Request.  It may also be just a reason provided as you guys pointed out, Smart have no standing with POFA.

    Thanks to all who advised and prodded me in the right direction.
