Don’t worry, we noticed as well!  Glad you did it though because the parking firms will have done.

  • Just a thought Opp. have you found out who owns the car park?   Find out and send them a polite letter explaining what happened and there is a strong possibility they will tell the parking cowboys to cancel the ticket.

Yes I did but Smart Parking wouldn't tell me. It is owned by Monmouthshire County Council.  The retail park is within Newport County Council. They bought is in 2018 as an investment and it is they who started the fining regime.  I am currently havinga  dialogue with them but I suspect they will not waive the fine.

    It’s not a fine.

The first reply I gave you tells you how easy this one is to win at POPLA.  Copy any Smart Parking POPLA appeal from the last couple of years.

    easy!

    Council owned land.

Then they cannot use POFA to transfer any driver's liability to the keeper.

I've not read back through the thread, but do Smart know who the driver was?

A combination of Smart and 'not relevant land' makes the keeper almost invincible.

I am not sure how this works.  Monmouthshire Council Esates Office bought this as an investment venture. The land is within Newport County Council authority.  I am not at all sure if it is classed as council or private land.

But I asked "do Smart know who the driver was?".

If they do know that, then there is no point in discussing the 'not relevant land' issue further.

No. The appeal was made by the owner of the vehicle.

And as I said twice, you don’t even need that because Smart don’t use the POFA anyway.
