My O2 complaint did not result in a satisfactory outcome, (no surprise) they did not pay any attention to the legally binding settlement agreement which was reached voluntary between Telefonica UK Limited and myself on the 18th July 2011 where it was agreed
… The tariff will be available to you for life unless you choose to terminate it or apply to change your tariff
I therefore opened a complaint with the Ombudsman and am awaiting the outcome of their investigation, their decision was due yesterday.
In the meantime, my O2 online account shows that they have now moved this connection from the Pay Up Front for Life Contract to the ‘O2 Unlimited 30D 500MB’ at a cost of £0.00 per month, it also states that the contract is for 1 month with a renewal date of the 4th May 2011!
O2 have applied the new terms and conditions by default which allows them to make changes to the agreement at any time (clause 20.1). There would be no legal basis for any claim down the road should they decide to move the tariff to a different tariff that was a disadvantage to the user.
The current contract is a 30-day rolling contract so the upfront ‘for life’ bit has already gone according to O2.
I will post here the decision from the Ombudsman when I receive it, dependant on that if it requires me to take the matter through the legal channels to reinstate what I actually paid for then I will do so.

My last bill was 20th September so I should be on the new the new terms. When I look at my tariff online it shows ‘Mytime Net 200 Pay up Front’ and the contract length is 12 months, that is exactly the same as it was before my last bill.0

Checked my puffl on line account today and it's exactly the same 12 months pay upfront for life.0

The Ombudsman decision has come through today, the outcome is that the Ombudsman has Upheld my complaint and have come up with 3 remedies: -Remedy 1Remedy: ActionComment: O2 to provide a letter of apologyRemedy 2Remedy: GoodwillValue £: 50.00Comment: O2 to provide a goodwill payment of £50 to you directlyRemedy 3Remedy: ActionComment: O2 to provide you with a payment of £3,000 or it takes legal action to revoke the current legal agreement
It will be interesting to see if O2 appeal the Ombudsman’s decision or chose to accept it and if so if they chose to go back to court or settle at the proposed figure of £3k and if so then getting a PAC code for the number will be the next battle maybe…
This outcome in my view is totally justified and has improved my opinion of the use of the Ombudsman’s alternative dispute resolution service no end.

In an ideal world none of this would have happened and I would still be on the 50 minutes a month to on network and UK landlines I do not need and I did not ask for anything any different.
What happens next is out of my hands, it depends on if O2 accept the Ombudsman’s decision or not, whatever this Ombudsman decision adds weight to any case if I end up having to take the matter to court myself again.

Hello. I found out that 02 have moved my old PUFFL phone to a ‘O2 Unlimited 30D 500MB’ tariff. It has unlimited texts and minutes plus 500Mb data with no line rental. Sounds too good to be true. Is it the case that once on this tariff they can move you onto a chargeable tariff, or bring in charges to this O2 Unlimited 30D 500MB tariff.?I did not get a letter, just a text that the tariff had just moved. Yes it is bringing this number into modern life instead of just using it for 200 mins a month as I had before to 02 numbers and landlines. How is everyone else getting on with theirs which moved a few years ago??And what happened with yours c8rls, do you think what you did was for the best?0
