Disputed Ryan Air flights upheld by AMEX.... but Ryan Air have charged me again!!

Hi all,   I put some Ryan air flights into dispute a year ago which Amex investigated and supported my claim.  I got the cost of the flights refunded -Ryan Air did not provide enough evidence to overturn the dispute.  We are about to travel with Ryan Air again this summer and they have recharged me for the cost of these same disputed flights - I can't travel with them until I repay for the flights we couldn't take, it was against foreign office guidance to travel.    Anybody experienced anything similar - and what might be our rights here?   Thanks very much, JC

    Did the flights go ahead even if you did not travel? because you chose not go it would not be Ryann Air,s problem ,and remember gov advise is advise and not law ,did you not claim off your travel insurance ?

    You have done a chargeback and AmEx has relied on their T&Cs to go into RyanAir's account and take the money back out.

    The thing is, banks don't have the legal right to make decisions on if the debt is actually owed or not, they rely on contract law to simply change the balance but not resolve the underlying problem. 

    Some merchants will issue court proceedings against anyone that does a chargeback, Ryan Air have adopted this new approach of making it a debt that must be cleared before you can fly with them again.  So pay it off and fly with them or choose another airline. If you wanted a final resolution you'd need to pay it off and then go to court to recover the monies because the judge, unlike the bank, does have the right to make a legally binding judgement.

    Not being able to take flight due to FCDO advice is not a reason fro a refund of the flight still went.

    Ant claim would be trough your trsvel insurance , if you had the appropriate cover.

    I guess that at the time Ryan Air didn't have the resource to even respond to the monies being claimed. Now they are slowly catching up and making due recovery of monies erroneously reimbursed.

    I had a lucky escape with Ryanair around a year ago when they cancelled my flight. They were very slow and difficult to refund so I also initiated a chargeback via Paypal which was very smooth.

    Unfortunately, Ryanair did not blacklist me so more recently I actually travelled with them. Having been on a few low cost airlines I was expecting fairly poor service but it was much worse than I could have imagined: 3 hour flight with seatbelt signs on the entire journey "due to covid" etc . Due to limited airlines flying certain routes it can be difficult to say you'll never fly again but boy will I try very hard to avoid in future.

    I have a bad experience with Ryanair resulting in my case going to ADR.
    whilst ADR agreed with Ryanair excuse of on Safety grounds, they also sided for me on the basis Ryanair did not do enough (sweet nothing) to get the passengers to Manchester Airport to catch the diverted flight.

    fair play to Ryanair did pay up within a few days, but as a result I swore I would never travel with them again, to date I have kept to it.

    I wonder though if I'm blacklisted

    I suspect the seat belt sign was left on to stop people wandering around the plane ,we flew on Jet2 a while ago and thet asked people not to queue in the isle for the toilets ,waste of time ,as with most flights we have been on the moment the seat belt sign is switched off the queue forms.

    You've received money back that they believe you weren't owed - and if the flight went ahead but you chose not to travel due to travel advice (and it's just that, advice - not the law) you're not owed a refund. 

    Amex may disagree, but them clawing back payment doesn't change the fact you weren't entitled to it - so they will quite rightly claw it back as they have done. Nothing to stop them doing this.

    If they cancelled, they will not attempt to reclaim a chargeback as they have no right to the money (unless you were refunded twice).

    Seat belt sign is at Captains discretion (usually delegated to the FO if PF), and Ryanair are not the only airline to do this.

    OP has received money they may not have been entitled to under their contract with Ryanair (who do not sell refundable flights unless they cancel), therefore they must refund Ryanair the money they fraudulently claimed from the airline.

    I guess you must travel in a world I've not seen. I've never been on a 3 hour flight with zero turbulence and the belt sign on constantly. Surely, this stems from company policy rather than a sadistic pilot?

    That wasn't the only issue but this isn't the thread for it.
