    But post #3 of the NEWBIES thread already tells everyone how to appeal to POPLA and what choice to tick.

    IP don't use CCTV, there wil be absolutely no CCTV but you can put this as your first point:

    Essentially, after parking for less than an hour we were in essence "prevented" by a very curt Initial Parking employee from actually paying (the 1 pound parking fee) as he didn’t like that my young son's bike rack (for his Disability Trike) stuck out some 50cm or so from the rear of our camper.  He said it made it over-length... and sternly told us to leave the carpark immediately OR would get a 100 pound fine!!  The clear understanding being if we just left, that would be the end of it.  

    Being a Blue Badge holder and needing to park as physically possible to the playground (our lad wanted to visit) we were shocked at the IP employee's uncaring attitude and stance.

    Signage clearly stated (as does landowner's own website) that payment can be made at ANY time and yes we WANTED to pay

    Attach a copy of the Blue Badge and a photo of the bike rack and then of course add the usual template POPLA appeal stuff about landowner authority and signage, and:

    Add another paragraph that shows the newspaper article where it says Fistral Beach has a 20 minute grace period, this was in a local Newquay paper a few years back.  State that an addtional grace period is required for disabled people anyway, but the landowner clearly sets even the time for able bodied people at 20 minutes because the driveway into this site is so long.

    And add another paragraph to your POPLA appeal Word doc (which you then save as a PDF before uploading it under 'OTHER') that the employee was wearing IP identification and a Body-Worn Camera so you put the operator to strict proof to include the Body-Worn video footage (and audio if any) in their response to POPLA to clear up what really happened, effectively a promise that there would be no £100 'fine' as you had to leave.

    Don't tell us you don't know if he was wearing a BWC, he was!


    Also, this is important to stop this happening again and stupid 3 figure sums being applied:

    We are also getting people to complain to their MPs and ask questions of the MHCLG because there is a horrific (very obviously PPC-led) naive mistake in the proposed framework that will CAUSE court claims:

    To be clear, we need individuals (you and your family and friends, separately) to do the consultation linked there AND we are now calling for everyone to ask their MPs to raise with the MHCLG, what the heck has gone wrong since March, that they now think it's OK for false debt recovery costs to be added that positively drive cases to court?  

    What are the MHCLG thinking? 

    That added sum was supposed to end.  The Knight Act included MPs unanimously condemning charges as high as £120, but this proposal takes it up to £200 and FUNDS THE ROBOCLAIM RACE TO COURT 

    We want MPs to kick up a stink.  This MUST be stopped.

    Ah OK but maybe the OP can still use the newspaper article to show that beach car parks in Cornwall need a longer consideration period (and IP now operate at Fistral Beach...so they know this) and he/she puts IP to strict proof of what the grace period at this Penzance car park actually is, as set by the landowner specifically in the agreement.

    We also need people to contact their MP to ask questions about why the MHCLG appear to have performed a U-turn on their March promise to cap parking charges, and why instead they propose to fund the race to court at £70 a pop? 

    Posters are being encouraged to ask their MPs to ask questions about why  PPCs have been allowed to persuade the MHCLG that they can add £70 per PCN for sending the same letters ParkingEye always do.  

    That would be handing ParkingEye maybe £70m extra per annum from public pockets! 

    Even where your PCN isn’t from that company (and pretty much all others do add the unrecoverable costs) I am sure you object as we do to this extortionate illegality!

    The proposals breach primary law!  I just looked at the POFA Explanatory Notes (part of the legislation):


    221.Paragraph 4 provides that the creditor has a right to recover unpaid parking charges from the keeper of the relevant vehicle if the conditions set out in paragraphs 5611 and 12 are satisfied. The creditor is not obliged to pursue unpaid parking charges through this scheme and may seek to do so through other means but they may not use the scheme provided for here to secure double recovery of unpaid parking charges (paragraph 4(6)), nor will they have the right to pursue the keeper, as opposed to the driver, of the vehicle where they have sufficient details of the driver’s identity. The right to reclaim unpaid parking charges from the vehicle keeper does not apply in cases where the vehicle has been stolen before it was parked, (paragraphs 4(2) to (3)), or in certain circumstances where the vehicle in question was a hire vehicle (paragraph 4(7)). The creditor may not make a claim against the keeper of a vehicle for more than the amount of the unpaid parking related charges as they stood when the notice to the driver was issued (paragraph 4(5)

    Some of my family are off to Cornwall today including two teenagers and their girlfriends in one car. Three cars in total including one with a disabled passenger. Which are the hotspots? Marazion and Fistral Beach are ones that I have seen on here.
