Ok, thanks both. I'll email BW and say I'm not accepting responsibility for the fine and outline my defence. Although I'm not sure what that will be yet! I'll search the thread.

Their counter will be that their client does not issue fines , they issue parking charge notices , invoices
Do not mention the words fine or penalty , because it is easy for them to refute that allegation , instead of concentrating on real issues3 -
Aa nearly all claims made by a PPC are flawed in some way it is always worth contesting them unless you are a serial bilker.You never know how far you can go until you go too far.1

Hi Guys. BW have sent me a text this morning (instead of a letter!) saying a discount or payment plan may be available if I contact them to discuss.
I'm going to email them this:
I dispute the inflated charge that you are claiming for. As I mentioned to you in previous correspondence, I never received the original parking charge from NCP as they were sent to my old address. I have been in contact with the DVLA who told me I had changed my address in August 2018.On the day in question (June 20th 2019), the parking machine had someone else's card in it. We gave it to a police officer who was nearby. The machine then wasn't working properly so we called NCP to explain the problem. We were informed over the phone that we were fine to park.
This is what happened. Just checking it sounds ok.

Maybe you only changed your driving licence but that doesn't change the car's registered address. What version date is at the bottom of page one of your V5C? That shows when it was last changed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I no longer own the car so don't have the V5C. Best I leave that part out then! 0 -
So, BW have replied to my email. Basically saying that I should have changed my address correctly with DVLA (I know
). They have also attached 10 photos of the car park in question showing all the signage and two parking machines. I had told them one wasn't working properly as it had some one else's card in. They have asked to get in touch with them with a payment proposal! Charges currently stand at £160.
I'm not sure what to do next. If I ignore and they issue court papers I'm a bit concerned that I'll lose, as I technically can't prove anything.
Any advice appreciated.0 -
Some say that the "contact to come to an agreement" letter/email is a last shot across the bows before they discontinue. No idea if that's the case here though.Jenni x3
