All are fine (if you have them) except your phone number - they have no need of it.Jenni x3

I just recieved an email from BW Legal saying they are putting my case on hold for 30 days as per my request. I've received an email from NCP to say they are processing my SAR request.
I guess I just sit tight and wait to hear from NCP now?
Thanks1 -
Hi guys.
So we're well over 30 days since I sent a SAR request to NCP and although they acknowledged my email, then still haven't sent anything through.
BW Legal have sent me another letter (as we are over the 30 days I asked them for) with an expenditure form for me to fill out. Not sure what to do next - is it worth chasing the NCP data team for SAR?0 -
Ignore the b w legal request for now , no feeding the opposition !! Yet
Send a follow up SAR email to the DPO at NCP , reminding them that your 30 days notice has now expired with no reply and you give them 7 days to reply back or you will report them to the ICO for non compliance with the law named GDPR3 -
NCP replied today with my SAR request and sent copies of the letters they alleged sent to me, along with pictures of my old car going in and out of the car park. I never received the actual letters from NCP as we'd moved house in 2018 (the 'offence') was 2019. I've checked with the DVLA and I changed my address in Sept 2018, which proved I never received the original PCN's as they were all sent to my old address.
With this in mind, do I wait to see if/when BW go the court route and then use that as my defence?
Thanks,1 -
How on earth did they get your old address if you changed your logbook correctly in 2018? Or do you mean you only changed your driving licence, which does nothing?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just to clarify ... have you already done the data rectification notice to tell them to update your address and erase the old address? (Just in case they try to be fly and send a court claim also to the old address to try and get a default judgment due to you not defending [because you wouldn't receive the claim]).Jenni x2

Ah, now my enthusiasm is curbed!
Coupon-Mad - I sold the car in question in mid 2020 so no longer have the logbook, but you could be right - I may have just changed my license address.
Jenni_D - I told BW my correct address as per the adivce on her when asking for 30 days, but didn't ask to erase the old one.
Not sure what I do next...0 -
Not sure what I do next...If you've previously responded to a BWL formal Letter of Claim denying any debt then just await their next move - probably a N1 claim form from the Northampton CCBC. Whatever you do, you do not complete the forms they have sent. Your income level and the other intrusive questions they ask are none of their business! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Loads of people think that sending even off their driving licence to the DVLA changes all DVLA databases...because under the GDPR, it should.
But it doesn’t. The DVLA are causing CCJs and financial loss for people, due to their failures.
Your case is no different than any other and will he defendable, no risk.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
