    So it seems POFA compliant and 57 minutes on site , alleging that the initial grace period was exceeded !!

    If it was 20 minutes plus zero minutes , the allegation is correct and difficult to argue against

    CM stated that both appeals will probably fail

    So you now have all the advice we can give

    So de minimis will apply again ... plus frustration of contract. There was no loss to the landowner / PPC as the vehicle was on site for no longer period than that purchased - hence de minimis. Purchase of the ticket took longer because a) others were buying tickets and found the process highly confusing, and b) you also found the process highly confusing, so this coupled with the time taken to actually park and walk to the single (?) machine meant it took longer than the "grace" period to complete the transaction - hence frustration of contract.

    If you've paid for an hour's parking, and, regardless of when you put your coins into the machine, your vehicle was recorded in and out in under one hour.  Regardless of BPA made up rules about paying within 10 minutes, you have still consumed less of your parking time than you've paid for; a Judge will bounce them out of court if it should get that far. 

    Unfortunately you have to jump through every hoop they roll in front of you to make sure it gets to a court hearing with you involved, or OPS discontinue beforehand. This could take a while.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Like I said. This won’t be likely to be won at POPLA. We all know the industry operates what the Government last week called “rip off” charges and this is nothing new. 

    There is nothing to discuss at this stage and this is normal for OPS cases. No paying it, give POPLA a go with the evidence about signs that DON’T have the10 min sticker. Then if you lose, sit tight and make sure OPS have your new address if you move. 

    Don’t pay it. Don’t ring them.

    "Give POPLA a go with the evidence about signs that DON’T have the10 min sticker."

    Have downloaded five photos signs and just to be clear, I can only see a mention of a grace period before paying on two of them.
    One mentions the 10-minute period. The second mentions 15 minutes, although that might refer to disabled motorists. It's not clear.
    Does that tally with your reading of the signs on the photos?

    Yes - and at POPLA stage you could use the 3 that don’t have the sticker - but if you are only at first appeal stage just use the template appeal because appeal stage isn’t going to work anyway.
