No PCN issued but received LBC

    so the SAR will show then that the PPC didn't actually ever send us the PCN. I would guess that that fact means that they can't charge us for not paying for something that they never told us about in the first place. At least not more than the original 'fine'

    If it's somewhere you never went or you know categorically that you were elsewhere and can prove that it might be helpful.  Or if they can provide a picture of the car that might prove it's not actually your car.  Even if it's the same make and model there might be a teddy bear on the dash or the driver, who is no one you know, is visible.  Hopefully the SAR will help resolve this.
    hopefully not ,but its possible. problem is we use that car park all the time to go to the pet shop but are never there long at all. We would have to be there over 2 hours for this to be issued which we have never done

    Is it possible that there were two visits to that car park on that day?

    It is not unknown for a parking company to 'conveniently' overlook the first exit and the second entry such that it looks like one overlong visit occurred.

    Is there any reason for not telling us which parking firm is involved.

    Yes please tell us which PPC and you will need to email Gladstones and tell them that their client has never sent you a PCN at all, so they cannot escalate to debt demands. 

    Tell them you are guessing that the delay by the DVLA to get around to updating the V5C has caused their client to send the PCN to the previous car owner who has presumably named you. 

    The PPC can’t ask the DVLA twice so you updating the V5C has not given the PPC your name and address. The previous owner must have. 

    The point is that the PPC then had to start again and send you a non-POFA PCN (driver liability not keeper, due to the delay!).   They can’t just hand your details to Gs with no PCN or appeal offered! 

    Also complain to the parking firm by email via their DPO, telling them they have abused your data by handing it to Gladstones without offering appeal on a PCN first.  Tell them you will report them to their Trade Body for doing this. 

    NO SAYING WHO PARKED THE CAR IN ANY OF THESE COMPLAINTS.  YOU ARE THE REGISTERED KEEPER AND THE DRIVER WILL NOT BE NAMED.

    Hi all. The PPC is parking control management (UK) LTD.

    I told Gladstones we had never received a PCN they just said their client won't care about that and probably a problem with the mail. 

    The previous owner wouldn't have our details so I can only assume Gladstones has requested it? or they did have it right in the first place and for some reason we didn't get it. 

    Not sure I want to play my hand to them just yet, I think I should wait for the SAR results so I can be sure what has happened. if they didn't send us the original PCN then that will be evident by the lack of one in the SAR. I did ask them to send us all details they have pertaining to the VRN and the original PCN so we will see. I may just go straight to their trade body instead

    Im most interested in seeing the photo evidence from the ANPR as we are sure we weren't there that day and especially not for that long.

    its not surprising that the trade body is the IPC - an offshoot of Gladstones

    The previous owner would have had to have had your details to fill in the 'sold' section of the logbook to tell the DVLA that the vehicle had been sold.  There is no other way that PCM have obtained your data because they couldn't get it from the DVLA after having already asked once.

    Actually, the SAR should include any comms about how they discovered your name and address.  For example if the previous owner provided it by email, they'd have to show you that (redacted) email because it contains your name and address and VRM.

    PCM are horrific ex-clampers with form, exposed as rogue traders on Watchdog:

    OK.

    But going to the Trade Body almost certainly won't help because it's the IPC (sadly not half as approachable as the BPA and yes, we know about the erstwhile Director/shareholder connections with Gladstones).  Still, worth doing just to see what response you get back at a time when the Trade Bodies are under scrutiny by Government.

    Ok that would have been the garage we bought it from then. I can call them and see if they can shed any light on it as they are at least a decent company.-- update I called the garage, they were the ones that had our details but they don't register the car in their name. they also confirmed that they haven't had any PCNs for the car. so at this point I don't know where Gs got our details from as it can't have been the previous owner as they didn't know them just the garage did.
