No PCN issued but received LBC

Hi all

Thanks for your help in advance. we received an LBC from Gladstones today regarding an unpaid PCN that we didn't even know about. This is the first we have heard about it. I have read through the guides on here but couldn't see anyone that had an LBC without first receiving a PCN and wondered if this makes any difference?

    Have you recently moved and failed to update your V5C with the DVLA?

    Thanks for your reply. No, we actually bought the car after moving here so has always been registered here since we have owned it

    Perhaps the previous owner incurred the PCN before you bought it?  Does the LBC state who the PPC is?  If so, submit a SAR to the DPO of the PPC (all acronyms found in the fifth post of the NEWBIES).  This should flush out the original PCN.  All done in witting do not phone a PPC or a solicitor or a debt collector.

    we bought the car on 09/03 and the alleged PCN was given on 12/04. so there is a possibility that the DVLA had not made the change in time, but as the V5 was sent in straight away I doubt it. If that is the case though the PCN would have been sent to the previous owner and not to us. I don't see how we can be given a LBC without knowing about the PCN at all though through no fault of our own.
    I have done a SAR request so hopefully will see what evidence they have, as currently we don't know, and if they ever sent us a PCN

    ha I posted before I saw your reply! yeah it does state who the client is so have, after much ferreting around for the DPO contact, sent in the SAR. I guess we have to wait and see now but we are certain neither of us was anywhere near the car park at the times they are stating. for a start it is my wife's car and she was at work 20 miles away! We have also spoken to the retailer who has emailed the PPC directly

    Might it have been a misread by the ANPR then?  PPCs (or any company for that matter) have 30 days to respond to your SAR.

    possibly, there just seems to be a lot of odd things going on with not getting the PCN and us being sure we weren't there. I suppose there isn't anything I can do until I get the SAR results, but we don't like having something like this hanging over us. 
    Thanks for all your help so far, is there anything else you think I could check or do that I've not thought of?

    Is it possible you have cloned plates?  Or someone else has cloned your plates??

    If it's somewhere you never went or you know categorically that you were elsewhere and can prove that it might be helpful.  Or if they can provide a picture of the car that might prove it's not actually your car.  Even if it's the same make and model there might be a teddy bear on the dash or the driver, who is no one you know, is visible.  Hopefully the SAR will help resolve this.

    Look at your V5c for the Doc Ref number. There is a date following it.

    On my V5c it's at the bottom of the second page in a box headed "Official use only. Do not write in this space".

    The first line format is an eleven digit Document Reference Number followed by a dd mm yy date.

    That is the date that your V5c was last updated.

    If that is the case though the PCN would have been sent to the previous owner and not to us.
    And the previous owner would/should have returned it stating that he had sold the car to you.
    But that should've resulted in you receiving a PCN directly.

    Just checked and yes the update date is 14/04 which is 2 days after the PCN date. I didn't know that was there so thanks for that. that could explain why we didn't get the PCN if they sent it off straight away. I guess the previous owner just ignored it
