Cancel Factory Order
I placed an order for a new car last April. I was told it would be ready on or before July 25. I contacted the dealer yesterday by email only to be told the car would not be available until at least October 1st. I paid a £1000 deposit by credit card to secure the order.
I do not want to wait until October. Am I within my rights to cancel the order and receive my deposit back?
Thanks

What do the order Ts&C's say about the essence of time and changes in delivery date?
What loss do you suffer from the late delivery?0 -
I never received any t&cs. I haven't signed any paperwork.
I want to change my current car now0 -
There's a worldwide shortage of chipsets, car deliveries are being delayed everywhere.
Have they offered you a loan car until yours arrives, to allow you to get rid of your current car?
On the bright side, your new car in October will have a post-September registration and would probably have a price increase if you were a new customer.0 -
You've given the selling dealer £1000 without having ANY information about what you've given them that money for? Really?Jenni x2

How did you purchase, in the store or online?
if it was a distance sale then I’m pretty sure you cancel under the replacement version of “distance selling regulations”. It’s got a new name.
you simply send them the correct cancellation notice.
that should be enough for you to google it.0 -
You may not have received the Ts & Cs, but they will certainly apply. Ask for a copy.
You cannot say "I didn't sign anything, so there's no contract", because what else was the deposit and (I presume) build reference for?
No great surprise that builds are being delayed, for anybody that ever watches any news - there's a worldwide semiconductor shortage that's affecting all car manufacturers, as well as other industries. Bit lax of them not to keep you posted on the slippages, though.
You say the order was placed "last April"? Do you mean April 2020 or April 2021? Where in the world is the car being assembled?1 -
It is a UK built car. Order was placed April 21.0

Yes. CancelSorry I can't think of anything profound, clever or witty to write here.0

As well as the production of these chips being delayed, worldwide shipping is a mess.
Nearly 40 years in freight and I've never known it like it is now, a complete and utter mess.
