    I do get that, just wouldn't know where to start also I complained to the CEO of the builder and got this response.

    The approved planning scheme for the development required provision of a number of ‘unallocated’ parking spaces.  It was appreciated that these spaces would be required for use as resident parking but due to planning restrictions, HOME COMPANY was unable to transfer legal ownership of or grant exclusive rights to use individual spaces.  All applicable homes were therefore sold with a right to use the ‘unallocated’ parking spaces for the parking of one private vehicle.  This right was granted subject to adherence with such user regulations as are from time to time issued by the estate management company.

    Due to concerns over unauthorised public use or an imbalance of use as between residents, it was considered to be in the interests of homeowners who rely on these spaces to introduce a parking scheme in order to regulate their use. The managing agents were therefore instructed on behalf of the estate management company to introduce and administer this.

    I am sorry to hear that you have been experiencing difficulties with your parking, but you will appreciate that the scheme is there to protect all residents and necessarily involves compliance with published scheme regulations. If you have complaints concerning the operation of these regulations, you should discuss this directly with the managing agents. It is for the agents to advise on and regulate the detail of the scheme on behalf of the management company, in line with the principles of good estate management. It would not be appropriate for HOME COMPANY to intervene and comment on individual cases.

  • Just an update on this, I have complained to both my MP, landowner and the builder of the estate with little movement 

    I currently have 4x outstanding PCN's one of which is with a debt recovery agent 

    Tracedebtrecovery do keep trying to get in contact with me but I'm just ignoring the attempts and am awaiting the court date. 

    Will I get 1 date for all outstanding tickets or just 4 separate dates?

    The chancews if the PPC winning a court case a slim imo so stick to your guns.  These companies have no right te be in residential car parks, thet deter renters and buyers alike.
    You never know how far you can go until you go too far.

    Yep defo will be sticking to my guns with this one... management company are getting worse and worse

    What is the status of the other three PCNs?  If they have gone to letter before claim you might remind them, when you write to deny the debt, that they must advance ALL their cases in one single claim and not drip feed them, as per Henderson v Henderson.

    I'm currently waiting on the other 3 to get passed onto the debt collection agency, I did phone the parking "company" and inform them that they couldn't drip feed them but she said it past her remit.. not sure if I should contact the debt collection agency?
