Ccjs remaining after debt relief order

  • Perhaps the rest of the ccjs disappeared because they were from Lowell and before my debt relief order was even thought about. I had a load of debt letters through the door, so I had to phone them and I explained I couldn’t afford to pay them all off, I was on the sick and only getting ssp. And it was a case of buying food for the family or paying debts off. They could see I was making payments on one ccj. I was going to get evicted as well. I was crying because I was a bit emotionally unstable. I have two serious mental health problems and that’s why I was off work. And they were absolutely lovely on the phone and told me to send them copies of my notes from the pysciatrist and I did and they got back to me and because of my personal situation and the reason for my debts. They wrote it all off as a good will gesture and suggested speaking to citizens advice. I did and then they did my dro and the lady at citizens advice said put all the Lowell debts in even though they showed zero balance. My credit score may be crap and every thing will be on my file for 6 years but it was the best thing I’ve ever done in my life getting a debt relief order. Was a turning point in my life and my mental health did improve Because I could sleep at night knowing my debt was gone 
    No.  They went because of their age.

    Lowell wouldn't give a damn about any sob story, and they couldn't remove the CCJ's anyway. Only a court could, at your request.  As you didn't request it the only explanation is that they're >6 years old. 
    Nope definitely not 6 years old. I’ve had all my paper work out today looking one particular thing, I had a few ccjs off lowell and they’re dated 2016. It doesn’t matter anyways I just didn’t know if this ccj showing on my credit report was even meant to be there when the others havnt been there since my debt relief order went through 
    Then there's every chance they'll reappear at some point.  Lowell don't have any control over the CCJ entry and there is absolutely no reason why they'd pay money to get it set aside (if the claimant even could.)

    It's largely academic though, insolvency is the blackest mark you can have on your credit file so these CCJ's not showing has no impact at all.
  • That’s an email of lowell in 2017, regarding the acounts they closed for me. It does say the defaults remain there for 6 years. I just found it strange that the others disappeared and this one particular ccj has remained, the rest disappeared sometime between 2017 and 2018 when my debt relief was done. I had never asked the court to remove the ones that went off my credit report.

    Yeah I don’t think it makes any difference when that debt relief order is on my credit report. Nothing is worse than that

    They didn't write off your accounts as a gesture of goodwill, they were part of your insolvency.
  • They wrote the debts off as a gesture Of goodwill, they send me letters saying zero balance and they wouldn’t be enforcing them. It included them in my debt relief order which happened after that just because the adviser from citizens advice said it would do no harm for them to be included. I don’t know why you’re telling me what happened when it didn’t happen to you so you don’t know. Your just being an !!!!!! saying lowell wouldn’t believe a ‘sob story’ so you’ve obviously got some sort of problem. I don’t need you to tell me what did and didn’t happen. My questions been answered anyways now

    Clearly stated by the OP, the accounts Lowell wrote off preceded her DRO by about a year.

    Its not clear why the public information should not still be visible, it could be its been temporarily hidden by the CRA`s for some reason, or it may have been removed in error, whatever the case, keep your eye on your file, as its likely the information may re-appear at some point.

    Thank you. I’ll keep an eye for them incase they return. The ccjs were dated 2016 so they should disappear next year. Thanks for your help I appreciate it

    It does, but just because they say that doesn't make it true.

    Companies use "gesture of goodwill" almost all the time, usually to avoid admitting wrongdoing.

    Don't read too much into it.
