Right to buy denied


Hi
I am a council tenant since 2013. All docs showing that landlord is city council. I always pay my full rent to housing department but when I applied for right to buy, they denied on the ground that property is not owned by housing but owned by Education. Need advice. Thanks

The council can rent to you, and be the landlord of a property they have a long lease on if that's what you are saying is the case.
Just like some councils rent out properties owned by other individuals but are leased by the Council for social housing.
As far as the tenant is concerned their relationship is with the council only.1 -

Depends on the rules of the scheme that apply in your case, particularly how ownership is described... or not described.
Ask council (calm, polite, in writing/email) for more background.
In your shoes I'd spend £3 today (before contacting council) and buy deeds online (5 minutes) and see who's name is on the deeds as owner.
Do let us know what it states, please!
However, completely different point, not keen on the scheme or taxpayer spend.

They can't sell you the property if they don't own it. Only the owner can sell it to you. The owner appears to be Education whatever that is. If Education own it they won't be able to sell it to you as part of the Right to Buy scheme. If you really want to buy it they might sell it to you but they won't have to offer you a discount.

Sounds like a different council department, rather than it not being owned by the council at all. So the house dept don't own it, the education dept do. Your rent goes to the council just another department.
This may well mean rtb doesn't exist in this scenario.3 -

OK the property is owned by the City council but it isn't owned by the City council housing department? What they appear to be saying is that Right to Buy only applies to housing owned by the housing department and not by other council departments. This makes sense because housing that is owned by the housing department is housing that is used only for housing people. Housing that belongs to the education department could be used for other uses like office buildings because it isn't designated as only to be used as housing it is just leased at the moment as housing. Is this property on an estate or is it near a school or college?
