I don't think that is the same car park as indicated on the signs nor where the OP parked, it is too far away.  The sign states 200 yards on right which would seem to be where the big house is.  If you use GSV and the time machine, go back to 2009, there is a gate, which is open, a sign and a hut for payment.  The owners of the golf club are at fault for not removing the sign stating public car park 200 yards on right!  This is why I say you should contact the golf club with a serious complaint.

I agree totally but what I think has happened is that the golf club has decided to stop using their field for public use but the whole thing is a pigs ear and needs a complaint of course the PPC would carry on regardless anyway.

In which case there should be a barrier or closed gate at the exit of the Golf Club car park and the golf club should take down the sign that still states public car park 200 yards on right!  I believe that the Golf Club are responsible for this trap.

There's been no reply from the golf course management since I've replied to them on the 12th. I'm starting to think that they're trying to deny liability that it's their carpark?

Brilliant!  Now please make a difference and lend weight behind our final push for fairness.

Do us and yourself (and the driving public) a favour and stick around on this forum every week - at least for the Summer - to ensure you see when the Government publish and open the final Technical Consultation.

    Nice one Tiger! ⛳️
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

We will be talking about it and the public will have about 4 weeks we think, to tell the MHCLG what you think about the level of parking charges, that the MHCLG has admirably decided already will start at £50 (50% discount) and not £100.

It's not open yet but please keep check here to see when it is.  We need real people like you to counter the spamming that happened last time from the industry.
For sure! I'll keep checking in every now and then and will back it!
  • Hi All,

I'm looking for a bit of advice on this, I had the same issue at the same site in August.

I parked in the gravel area of this car park (highlighted in blue in OP's site map), I got out of the car and looked around the entrance for the payment machine and couldn't see it anywhere for the life of me (turns out it was hidden behind a bush in the grassy area of the car park (marked red in OP site map)).

I went back to my car and tried to pay by app or phone, the only advertised way to pay that I could see (I couldn't see any signs advertising or pointing to the location of the payment machine). unfortunately, given the location of this area of Devon, my phone signal was incredibly poor and I didnt have the level of signal required to connect to the phone number, let alone downlod the app.

Due to not being able to pay I left the car park, 19 minutes after entering, and then recieved the letter from CE Ltd when i got back to the east of england from my holiday in Devon.

So I did a bit of research (obviously not enough because i have only just found this post) and submitted my appeal to CE Ltd, obviously lost. I then followed through to the appeal process to POPLA and unsurprisingly lost that too.

So I guess my question is, if i was to email the golf course, as OP did, would they be able to cancel the charge or would they even be inclined to considering I have lost two appeals.

I'm also quite dubious as to whether CE Ltd is actually contracted to control the blue area or the car park, considering the absence of pay and display signs, this is reinforced by the planning permission they have for the payment machine which marks only the field at the end as the site plan. The gravel area seems like it may only be for memebers of the gold club only.

Anyway, any advice would be greatly appreciated!

If you don't ask , you don't get , so yes , complain

Plan A in the newbies FAQ sticky thread near the top of the forum in announcements tells you that plan A is to complain about the PCN to the landowner , that advice never changes , you failed with plans B and C , plan D is Court !

    Plan A is to avoid plans B , C & D , or in your case , to avoid plan D !

So if you don't try , you won't know , so lack of action means court is on the agenda at the moment , unlike the person who posted this thread
