It never fails to amaze me that people buying on ebay expect you to act like M&S
I have bought and sold on ebay for years and on the whole have had very few problems.
I did buy some craft items and when they arrived they were much much smaller than I expected ,but in re-reading the listing I realised I had made a mistake so I just laughed it off and vowed to be more careful.It was not the sellers fault so i did not ask to return them.
As for the buyer in the OP ,she may not have been able to take it back to a shop unless it was faulty,not all shops are like M&S!:j I love bargains:jI love MSE0 -
My only concern, you mentioning it was a microwavable hot water bottle & supplied with no instructions, is that it's not recommended to use guesswork when heating these up.
There is usually a recommended time for them to be heated & if heated for too long they could become too hot & burn skin if used by unsuspecting person.
I think if it were me I would have felt very disapointed that an item listed as new came without instructions if it didn't state this in the description.The bigger the bargain, the better I feel.
I should mention that there's only one of me, don't confuse me with others of the same name.0 -
I can see your point cattie, I didn't even think of that when I bought the item. I didn't state that it did or didnt come with instructions.

In the past I have sold a few things that buyers have said 'weren't as described' whereas I thought they were. Since situations like this are difficult because it is really up to interpretation, I would suggest to the buyer that she should resell it on ebay and get some of her money back. It is not your fault that she misinterpreted your description and should have checked before buying if she wanted something very specific and like another poster has said, you are not M&S and she cannot have it both ways (paying less than retail but wanting the same t&c as retail buys).
I've also bought things a few times where I thought the description wasn't quite right but was also somewhat up to interpretation and I have simply sold these on and recouped any monies spent on them in the first place.0 -
personally i wouldn't refund-she's used it now, it's second hand!, you are not a shop and you've not misled her in any way, all questions should've been asked before it ended.
if she had bought the item from the shop and tried to return it i doubt she'd get a refund unless faulty as she admitted she's used/tried it, any retail shop would not be able to sell it on therefore losing out
the worse you'd get is a neg.0 -
Tangentially related point- these wheat things will often give off some dampness the first few times they are heated, it's quite normal. I have 2 which I use for aches and pains. Heating times can be played with, try 1 min, then 1.5 to see if it's the sort of heat you want. I always do 2 mins because I like them very hot, but that would be FAR too high for a child, say,or anyone with thin or delicate skin.0

Thanks for all your help yesterday guys. I said I stood by my description, and she has now closed the dispute saying that the problem had not been resolved. Ebay sent an e-mail to say "T[FONT=Arial, Verdana]he buyer now has the right to file a formal Fraud Complaint for this transaction." - what does this mean??? I'm now quite worried that she will do this.

A seller has just closed a dispute saying it was unresolved. Ebay have sent me an email saying she now has the right to open a fraud complaint against me - what will happen? it sounds quite scary?!
we have basically disagreed over the description and I won't refund because she made a lot of assumptions about the item.
Any help gratefully received :T
