Yes, because liability for the purchase remains with the seller until it's in your possession. It will be more complicated if the tracking shows it was delivered to your address, though.0

(2)The goods remain at the trader’s risk until they come into the physical possession of—
(a)the consumer, or
(b)a person identified by the consumer to take possession of the goods.
Does the track & trace show the GPS location on a little map?
You should of course complain to your Royal Mail depot (in person if you can) to help prevent this happening again as the retailer may not be quick to just hand over a refund when the tracking says it was delivered.

We only open our front door for deliveries. A few weeks ago a delivery driver told me there was another package on the floor by the step.
Not expecting anything I looked and it was for a neighbour (the joys have having house numbers with numbers and letters).
Took it to her and she had already complained to the retailer and had her money back, as despite an email saying it had been delivered she hadn't received it.0 -

You need to find out from Royal Mail who has signed for it (although RM aren't getting signatures, the delivery person should record the name of the person who accepts the parcel).I don't know if RM will speak to you as it is the sender who has the contract with them or if you will have to get the sender to chase it up.Have you spoken to the sender?
