    Check your pm reply from @ParkingMad.  Also ask Peel, did you pay this off because this hasn’t helped, we were not wanting the CCJ merely to be ‘satisfied’ as that doesn’t remove the CCJ.

    Update! *Wooohooo* I’ve actually received a consent order for the judgment to be set aside. Do I pay the £100 fee or ask them to pay?

    That is progress.  It is up to you if you want to ask them for the £100.  Depends how much you value a CCJ free credit record.  How much have you paid out so far?

    If it was their fault you could ask them to reimburse you.  What does the consent order say?  Does it mention costs at all?

    The consent order @ParkingMad showed me says you ‘agreed settlement’ and only refers to CPR 13.3 which puts your application in a lesser position than it should be in IMHO. 

    I replied to ParkingMad (isn’t it daft Group pm’s have been pulled?).

    I think point #2 should firstly quote CPR13.2 then 13.3.  And your conclusion should ask the court to confirm, pursuant to CPR 13.2 that it is mandatory that this CCJ be set aside.

    And don’t ask for 14 days to put in a defence, ask that the claim be dismissed and costs awarded in your favour including the £255 set aside fee and any loss of leave fir attending the hearing. 
    Thank you for this. Do I then need to amend the 6 point Draft Order (seen above) again? really hoping to get this sent off today.

     Is this the UKCPM one, have they not bothered to reply to you request for consent? 


    4. Should the Claimant discontinue the claim after the CCJ is set aside, the Claimant shall pay the Defendant's costs of attending the hearing and the £255 application fee paid by the Defendant.

    @Coupon-mad nope! I sent it three weeks ago & they responded telling me to contact Gladstone’s. I received an automatic response saying I’d hear within 7 days, which I didn’t. I sent a chase up email again to both. 

    I’ve amended point 4, thank you.
