A technical point ... exhibits would normally be referenced using your initials and an incremental number; e.g. OJ01, OJ02 etc.

I think point #2 should firstly quote CPR13.2 then 13.3.  And your conclusion should ask the court to confirm, pursuant to CPR 13.2 that it is mandatory that this CCJ be set aside.

And don’t ask for 14 days to put in a defence, ask that the claim be dismissed and costs awarded in your favour including the £255 set aside fee and any loss of leave fir attending the hearing.

Hello everyone, I’ve received an email from the CCBC saying:

“the court's records have been updated to show the Judgment in case XXX as satisfied..."

I believe this is as a result of contacting the land owner, who then contacted the parking company after I had chased. I haven't paid the PCN so believe they've cancelled it.

However, it is just marked as satisfied, so what do I do here? Must I still go down the £255 N244 route? Or do I contact the parking company again and ask them to agree to the £100 route, since they’ve cancelled the PCN?

Thank you all so much for your help so far, I can’t tell you how appreciative I truly am.

If you want it removed, you will have to go for a set-aside and, as you say, N244 and £255.  You could try asking VCS but presumably, now they have been paid, they will ask "what's in it for them"?

The landowner has either applied sufficient pressure or has paid the PPC a ransom to get themselves out of the loop. The PPC will be happy with that, I guess, but the stain on your credit rating still remains - as the court order states, and you will still need a set aside to remove it, as @Le_Kirk advises above.

If my hunch is correct, it should mean that if the set aside is eventually granted, the PPC won't be back in resurrecting the claim and you then having to defend it.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So no point contacting them and asking them to agree to consented set aside?

I suppose you could do that and ask them to pay the £100 !!  Nothing ventured , nothing gained

It's still ruining your credit rating , until it's been set aside !! No matter who pays

Have they been paid? This wasn’t the way to do it but I didn’t think you’d paid them?
