I've been completely confuddled by the change in linked witness statement and became a bit hot under the collar when I could not even find the original on my computer! (I cannot explain why).
Anyway, I fortunately found the electronic version that I sent the courts, so attached is a new redacted version. It's been converted from PDF to word to be redacted and so a few of the yellow highlighted passages have become less transparent - they are just highlighting a few key points in the IPC's 'code of practice(lol)'.
Let me know if there are any further issues with this link:https://www.dropbox.com/s/pr6riiz9pvz15f0/WOBS2k-WS-REDACTED.docx?dl=0

Thanks for re-posting that example, @wobs2k and for sticking around here.
Hope you are au fait with the need to respond to the final Govt Public Consultation later this year, once the new Ministers at the DLUHC are in place?
Hopefully it will be open in the Autumn as early as October.
We all need to ram that nail in the coffin of the proposed and excessive £130 'London level' that nobody asked for, and the false £70 'DRA fee' add-on, that actually funds the court claim and CCJ culture, as well as the DRA gaslighting of people, pre-action.
If PPCs manage to turn around the decision on banning the gaslighting/claim-funding 'fees' then the DLUHC will be rubber-stamping £200 parking charges and if that happens, they (Government) and the PPCs will wreck high streets and people's lives - whoever is responsible if that happens (and it very nearly did in 2021) must hang their heads in shame.
Just checking you are among those ready to respond to the questions as you have personal experience of how this crap feels.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Absolutely! I was gutted to see the JR had been brought and will definitely take part at the next consultation.Where is the best place on the forum to keep an eye on developments?
PS. My new court date is set for Sept 28th0 -
Also, @Coupon-mad.....
Are there any successful precedents for campaigning to get local landowners to abandon cowboy firms and switch to a more 'ethically minded' firm?
Your comment about high streets etc made me think about the beach carpark that I (and many others) were nobbled by, and the massively negative impact on people's enjoyment of the play and consequently local businesses. If a 'grassroots' campaign could help the landowners see sense it would be to everyone's benefit....just wondering whether you've experienced/seen anything of this?0 -
Where is the best place on the forum to keep an eye on developments?I think @Coupon-mad intends to use this sticky as the vehicle to announce the commencement of the consultation. Probably it won't be until the (early?) Autumn after the Sunak/Truss show is over. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

There are no ethically-minded PPCs. Wish I could say differently.wobs2k said:Also, @Coupon-mad.....

We've certainly seen local campaigns work at Lichfield, Norwich and Peacehaven; this approach has the best effect when backed by an MP or Councillor:

Now this bit (Lichfield) is brilliant: -They’ve committed to upgrading the parking machines, ensuring that visitors get either a paper or e-mail receipt, and retaining the ability to pay by cash or card.

Well, had my hearing today. DJ Smith in Plymouth upheld the £100 parking fine but dismissed the £60 added costs (the idiots had used a recent photo of their signs and it had changed completely- and become less ambiguous- than my photo only 4wks after the day in question). Costs were £112.55 (they tried for 8% interest and she allowed them 1%!).I think with more legal nouse I might have pushed the abuse of process limb but was lacking in confidence. Also wanted to make a point about aggressive debt collection from BWLegal but didn’t get the chance (will refer them to regulators instead). Thanks for your help @Coupon-mad et al, very grateful and (though I hope I don’t have to go through this again) very reassuring to know you have the backs of the ‘little people’.Please let me know if there is anything further I can do to help bring down/put in check the activities of these parking cowboys and their ‘legals’ (pah!).2

So sorry to hear that. On what basis was the charge upheld: that the contact was prominent on very clear signs?
Was the Judge bothered about your late submission of evidence or was it not mentioned?
Well done on getting the false £60 removed and the interest reduced. Please let me know if there is anything further I can do to help bring down/put in check the activities of these parking cowboys and their ‘legals’ (pah!).YES! YOU CAN GET REVENGE:
please don't disappear just yet.
A final Public Consultation is coming, as you know. Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture.
There will be one window of opportunity later this year. My best guess is now November/December but we WILL be talking about it when it is open.
Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.
If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:https://forums.moneysavingexpert.com/discussion/6333989/mse-parking-ticket-appeals-guide-feedback#latest
This will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.
We need high numbers of real victims to make a point of responding to this final Consultation and your voice is vital. Look what they've done to you! Get angry and get even.
Spread the word on social media once the Public Consultation opens and certainly give your opinion to the DLUHC about the fake DRA fee that feeds the court claims and the toxic roboclaim 'legals'.
Also (as you identified earlier in this thread) complaints to landowners about PPCs are always worthwhile, even if it just makes them think twice a out renewing contracts.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, that the charge was clearly displayed on signs, I tried to argue that for 4mins it was disproportionate but she didn’t buy it.She expressed her distain at my late submission but said she was happy to proceed…the BWLegal ‘lawyer’ tried to add on costs for my being ‘unreasonable’ in my tardiness but she put him back in his box. I wanted to exposure they’re lack of understanding of the term ‘unreasonable’ which they’d also claimed I was for using your template, but I wasn’t sure whether that was the right forum to pursue BWLegal. Will definitely support the consultation.I feel that the ‘legals’ are the real brutes behind the whole operation- any suggestions on how to reign them in?1
