Stamp duty deadline

Looks like we’re going to miss it 😢 
our buyers haven’t even signed the contract or transfer paperwork because their solicitors advised to wait until all enquiries were conducted. But surely signing in anticipation is sensible? People were buying from haven’t either! Everyone wanted this but we’ve found out today we’re the only ones actually trying to make it happen. Mighty P**** off. We will complete at our leisure now. 
No question just want to rant to others in same boat!

    You've still got a week. How long were you wanting/needing between exchange and completion?

    We have but our buyers home survey won’t be back till tomorrow and I’m sure they will have questions. They haven’t signed documents and then their solicitors are saying 5 days to request funds and seems unwilling to request them until all enquiries are completed.
    we’re applying gentle pressure but don’t want to push too far.

    Is it common to exchange before survey? 
    I'm FTB so still getting my head around it all! But personally I don't think I'd be happy to exchange until survey came back anyway. Unless I've read that wrong 🤔

    No not exchange before the survey but get the paperwork ready. You sign but nothing is dated. We would not expect them to exchange without having the results.

    I feel you, we are missing the deadline because the vendor can't get the removals booked in... To be fair we only realised that we were in a position to complete around a week ago. We tried to push but she is also breaking the chain to make it all happen.
    I think the whole STH caused more stress and trouble than it was worth it.

    They always say 5 days. My solicitor repeatedly insisted on 5 days between exchange and completion because of the standard time frame required by lenders. Because exchange was delayed she kept saying completion had to be delayed. All of a sudden she changed her mind and the funds were requested and received within 3 days, then I exchanged, and then completed the following day (the original planned completion date). It can be done in less than 5 days just takes a little bit more pressure from the solicitor on the lender. 

    Why did your buyer get their survey done so late in the process? Delays in trying to get someone booked in? 

    I'd be wary of requesting funds before I had seen the contents of the survey. I know funds can be returned but perhaps the solicitor doesn't want the hassle if something as significant as that is outstanding.

    Also my solicitor was really late in sending over my draft contract. I signed it maybe three days before the original exchange date and then dropped it into their office in person.
  • Why would anybody sign anything before searches and surveys are back? What time would that even save?
