PCN Received from New Generation Parking Management - Advice Required

I don't wish to harp on about my case but I remember a few things that were said that may be of interest.
When their legal rep said this whole case could've been avoided had I given the driver details, the judged agreed and said 'you had the opportunity to do so and you didn't on a number of occasions'.
I replied that had the parking attendant engaged with us at the time and not run off when challenged it might not have escalated to this stage. I also said why wasn't the parking attendant asked to submit a statement as he was actually there?
The judge replied with 'WHY is that important'?
I even said that the only 2 images that were submitted were both taken at 12.57pm and judge asked 'so what time did you arrive'. I said I couldn't give a time retrospectively because we didn't know we'd be getting a PCN a week later, so any time would be guesswork.
Their legal rep could've taken the day off.2 -
Please give yourself a break, honestly this isn't your fault. None of us could have won against a Judge like that.
Remember that even Miss Jopson lost her first hearing (hence why her case is a persuasive higher level appeal - she did pay a solicitor to run the second stage though, and got those costs back). So it happens to the best of us when Judges go wrong.
In your case, that conversation with the ticketer was important because that was the trader's first opportunity to make a "reasonable adjustment' under the Equality Act 2010 whilst he could see the passenger was disabled.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Not to rile you up, but I've just come across this thread as I have just submitted my WS for a hearing in March, and you seem to have been parked exactly where I was when I had the same PCN back in 2019. I didn't think it would get this far and after submitting my defence, I thought NGPM might discontinue their claim. I was also a resident of the building at the time.
I'm also sorry to see that the case was lost, however I can't help but feel that has rustled a few of my feathers. I'll be attending the same court, but it looks to have been ordered from a different District Judge from the letter I have received. I also can't help but wonder that now the case was won by DCBL, that they are more confident about a case in the same spot perhaps? The circumstances are different along with the Judge, but maybe they will not be more inclined to discontinue my case.
I will post on the result after the hearing of course, which if won, may help your case.0 -

You can't tell from the hearing Order who your Judge will be. Cross your fingers NOT to get that woman.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
