    Will telling or not telling them affect the situation if at some unspecified future time the sewer pipe needs attention?  Is it's a breach of covenant and I told you when you moved in significantly different from surely you realised, yes it's a breach of the covenant?

    Its my business because the wall is build over my sewer pipe (as already said)
    All 4 houses have the same covenant.

    I don't see why your concerned because the wall is built so it's too late now and if the sewer doesn't need attention and the wall is in the way they it will just have to be knocked down to access it which won't be an issue because it's not on their land. So no real reason to bring it up now. 

    You keep mentioning the covenant but it doesn't sound like it applies because the wall isn't on their land and is on land owned by someone else. This still makes it wrong because it shouldn't be there but not because of the covenant.

    So, to sum up:

    1. Old neighbour built wall over sewer pipe, despite the fact they were not allowed to via existing covenant
    2. Old neighbour didn't declare this on selling documents, and new couple buy house not knowing the wall is over a sewer pipe (issue not discovered during searches, surveys etc.)
    3. You are now debating whether to tell new couple in the hope they will pull the wall down/some other reason

    Is that about it?

    How can they pull a wall down that isn't on their land? It's nothing to do with them as such.

    I certainly wouldn't worry about them finding out what you may or may not have known. Also, how do you know it wasn't discussed as part of the sales process and they decided to proceed anyway? 
    Its not built on my land, Highways Englands land (next to a main road) they may find out in the future.
    I have never be so sure that they were not told.
    If you've got a problem with the wall which is on Highway England's land, then the party you need to speak to about it is Highway England, because they own the land (and therefore, the wall). It isn't your neighbours' wall.

    Did you need a warning after over 3.5k posts here? On anything worth discussing there's bound to be varying points of view, not all of which you may like. No one expects you to respond to every thought others have had. You can let them go too.
  • I think you already knew what you are going to do about this but were hoping for justification from the forum. If you ask for advice its not always going to be on the side you want it to be.
