I'm not sure all I can see on any of the letters says support group0

If he's always been in the Support Group and he transferred from Incapacity benefit (which you stated in your other thread) then part of his claim must be Contributions based.

So why have you now saidJita76 said:Yes and that's when we were informed it was CB and element of IB.
The answer will make a big difference to the amount of overpayment that has occurred.Jita76 said:Yeah it was contributory with income based added on, and then it was income based only.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -
That's what I'm saying away, back in June when all the messing about happened when we called they said part of it was contributions and part of it was income related. Now on the letter it says he is not entitled to esa (ir), hence my confusion. I have tried to call them today on hold for just under 2 hours, had to hang up to get kiddie from nursery so will attempt again in the morning0

Edit: I've just reread your post, I think I must have misread it before! That means he's not entitled to the income-related part but the contributions-based part will continue.Jita76 said:That's what I'm saying away, back in June when all the messing about happened when we called they said part of it was contributions and part of it was income related. This doesn't mean he isn't entitled to any ESA at all. If part of his claim was Income Related then any overpayment will need to be repaid back.Best time to ring them is as soon as they open.0

Exactly - there is no entitled to the income based part.Jita76 said:..they said part of it was contributions and part of it was income related. Now on the letter it says he is not entitled to esa (ir), hence my confusion.
Entitlement to the contribution based part remains.
This doesn’t mean all of the existing award is income based.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -
Thankyou folks, I'll give them a ring first thing to see what's what. Head is fried with it all.0

^Good luck phoning the DWP. I had to phone the DWP (ESA) yesterday morning. Phoned at 8am and it had just gone 10am when I managed to speak to someone. That's by far the longest I've been on hold and by the time I did get to speak to someone my anxiety levels had gone through the roof.0
