CP Plus Ltd- absolute scammers!

Please do not read in just the once, it is complicated and needs several reads.

So, I have done the following -
1. Complained to road chef 
2. requested a copy of my DVLA record to confirm the addresses that my licence and V5 were registered to at the time of the incident and after I moved 
3. Written to CP plus with a detailed subject access request 
4. Contacted DCBL to advise that I will be disputing this given that no evidence has been provided to me and explained that a SAR request has been sent
5. obtained copies of my bank statements etc which prove that I was nowhere near the location on the date alleged

anything missing ??

If you haven't yet received a N1 claim form (i.e. this is not a live claim) you should add to your list that, whilst you deny any debt, you are seeking debt advice and require them to put the matter on hold for a minimum of 30 days.  Just a question, how will your bank statements prove you were nowhere near the location on the date alleged?

Great thank you. My bank statements prove I wasn’t there as there are payments out to the Dartford toll and the Eurotunnel as I was on my way to France !

Then POFA 2012 is your friend because it is likely that C P Plus failed POFA and so there is no keeper liability and there is no legal obligation to name the actual driver ( in civil cases )

A non driving keeper cannot be liable if the claimant failed to comply with POFA 2012

A complaint to all and sundry , including your local MP , reminding them of Sir Greg Knight MP bill 2019 and the new Mhclg new CoP being drafted on behalf of Robert Jenrick MP , the minister in charge , won't go amiss ( Rishi Sunak MP used to deal with that CoP prior to his promotion )

thank you- I might contact my MP about it. It’s definitely worth a try. But I would be reluctant to do anything involving Robert Jenrick. I’m currently stuck in a flat with cladding and other fire safety issues and he’s doing nothing to help us and has been about as useful as a chocolate tea pot but that’s another story !!! 

The POFA definitely helps too, as there was no notice to keeper sent

It is only your word it wasn't sent. Hopefully the scammers won't have proof of posting, but unfortunately when playing judge bingo, a scammer saying they sent a scamvoice is sometimes enough for a judge to side with them on that point.

As already advised, send DCB Ltd a series of questions every month to try and drag this out in the hope that you don't get a LBC from the scammers or DCB Legal before or after December the 18th.  From that point you can nudge it over the line fairly easily by waiting until just before the 30 days given to respond, then fire off a "I deny the debt, put proceedings on hold for one calendar month" notice.

I'm not sure that you want to use that put on hold notice on a powerless debt collector.

Does the Dartford charge require you to enter the VRM? The car can't be in two places at one. Ye canna change the laws of physics, as Scottie from Star Trek would say.

They have been using ANPR since November 2014.
