CP PLUS LTD T/A GROUPNEXUS - historic PCN 13/08/2015 & 12/01/2016 @ Moto - county court claim

Hi, recieved a Claim form from County Court business centre - for around £580 for what i can make out two parking fines 
Claimant claims £340 being total of the PCN's  + damages + interest (i assume total claim is £490.77 + £35 court fee + £50 legal rep costs)
I think i need to start by filing acknowledgement of service, but from there i'll a little sketchy
Due to the length of time i cannot remember what these incidents were or why i was at these stations at those times...

    So it's DCBL ....... the only legal who continues to lie to people stating "damages" which is normally a fake £60 ...... TOTAL RUBBISH THERE IS NO SUCH THING AS DAMAGES and is a fabrication to extort money. THEY ARE LYING TO YOU AND THE COURT

    Private companies cannot fine people, oplwase read the newbies.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    And complain to your MP

    All claims cancelled so far I think.  No links given, get researching.

    With a Claim Issue Date of 11th May, you have until Tuesday 2nd June to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Monday 14th June 2021 to file your Defence.
    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    I am sorry, not sure were the confusion has crept in but this is a court letter, complete with a claim no. sent from County Court Business Centre / Northampton - ive read through the above link but from my understanding, whilst it may have been a letter like the one described (I remember reading that they cant transfer or sell a PCN) it is now going to court... (issue date 11th May 2021)

    Yes we know ...  and we know it's Nexus who seem to have thrown money away buying into the scam.
    As it's MOTO that can get this cancelled ... write to their CEO.

    How long will MOTO put up with Group Nexus chasing their customers away, not long ?

     Imagine my surprise then, when I receive a court claims letter from CP Plus Ltd T/A Groupnexus, a company well known for shady and underhand practises, whose business model relies on intimidation, threats of legal action, illegal claims for damages and every slimy trick in the book, with a last ditch attempt to claim £575.77 for two PCN’s, one of which was in August 2015 @ Moto Trowel, the other at a Roadchef in January 2016.

     I find it difficult to understand why you would consider an association with your company and these shysters could bring anything but ill will towards you and your establishments. I for one will be avoiding them from now on and will encourage my staff, colleagues, friends and family to do the same.

     However, this is your opportunity to ‘do the right thing’ call the ‘dogs’ off and please consider kicking them into the long grass where they and others like them deserve…<<


    I have also realised that the 2nd PCN is with Roadchef not Moto so will need to seek out another CEO lol
