Can I please be advised on this? I've gone through some threads but I get easily overwhelmed and flustered. From what I can gather, I wait until I get a letter before claim?

Did you receive PCNs about this issue? If not, have you moved recently and failed to update your V5C? Please refer to the NEWBIE sticky (the one that says please read this first) and you will see on the fourth post what to do about debt collector letters.5

Your strategy is correct. DCB Limited are debt collectors and can be ignored - please read the NEWBIES FAQ sticky, fourth post, to learn about debt collectors. That's not to say they won't eventually move this on to DCB Legal who will issue a formal Letter Before Claim, which then cannot be ignored as they will have started on the road to a court claim. If you receive a LBC, then read the NEWBIES FAQ sticky, second post, which guides you through from that point to the actual court hearing, should it get that far.Have you complained to the car park landowner and asked them to intervene to get this cancelled?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you. The car park is used for several shops, some of which state they don't and won't deal with any parking charge grievances.Umkomaas said:Your strategy is correct. Seems like you did not inform DVLA when you disposed (sold or otherwise) the vehicle. Is this a possibility? I believe you can apply to DVLA to find out when you informed them by sending in the correct parts of the old V5C.Razma said:

In which case there is likely to be a managing agent responsible for the site. Try to find out who they are. If there's a large sign near the entrance to the site which lists all the outlets, often the MA's name will be at or near the bottom corner of the sign - Savills or Jones Lang LaSalle are two of the frequently seen MAs. Both are quite helpful in getting tickets cancelled (if involved here).Razma said:

The know the problems and that such claims by Highview will lose them business
The landowner of the car park is the place to go to get this cancelled, the landowner should be protecting the retailers against the scam.
DCBL are scamming you with fake add-ons so don't contact them, ignore them. If you get a 30 day letter before claim come back here.

Excel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

Send an SAR to the scammers as per the advice in the NEWBIES to flush out the original PCN/NTK. Do this asap.
Include proof of ID such as two redacted utility bills or bank/card statements. Never send photo' ID.

I sold it to Vauxhall directly so I don't believe it's an issue with DVLA changes of address. I'm simply putting it down to the naff practises of these ridiculous parking firms.Le_Kirk said:
