Neighbours planning rear dormer extension.

    I don’t understand why my neighbour is allowed 7 bed hmos in a similar size house.
    Is it a 7 bed or 7 people living there? 
    It’s 7 bed hmo. The front reception room and living room downstairs count has bedrooms.
    3 bed on first floor and 2 bed rear dormer.

    Are you sure?  How was that calculated?  It would be difficult to exceed 40 cu m with a single dormer on the back of a typical terrace.  Although it will be getting there if he does indeed want to add another.

    He is trying to cram more people in a traditional 3 bed terraced house. He is not bothered about quality of the tenants just how much money he can squeeze out of his houses.
    The thing is you don't know and if that is his plan he'll need to go for planning permission. If he does you'll need to make an objection but be realistic and not emotional.

    I have looked up recent PP for the road and in October 2020, number 8 wanted to convert 3 bed to 4 bed hmo but was declined on the grounds that there are 47% hmos within 50 metres of the house which over exceeds council 25% hmos target. I don’t understand why my neighbour is allowed 7 bed hmos in a similar size house.
    Well you have not confirmed if he is "allowed"?  Does he have planning permission?
    Possible reasons ..
     (1)  He applied for permission and it was granted
     (2)  It was done before the 25% limit was introduced presumably alongside an Article 4 direction.
     (3) He does not have permission but planning don't know or don't care so have not taken enforcement action
     (4) Planning did take enforcement action but it was quashed on appeal.
    The reasons should be apparent with some digging.

    Regarding the anti-social behaviour.  The HMO must be licensed and that comes with conditions that Landlords must address such issues.  Have you raised the issue with the Private Sector Licensing team at the Council?

    I didn’t check planning portal, i relied on my conveyancer. The planning was put in on 16th February and the letter from the council was dated 1st March. I exchanged on 2nd March.

    I have checked register of licensed hmo in the area and he is on it. I have raised the noise nuisance with the council environment dept through noise app.

    Putting an extended dormer on top of the current rear extension/ elevation (often a bathroom in that style terrace) would definitely be overbearing, you are essentially creating a 3 story building as oppose to a 2 story one (no slant of roof, but a wall of brick).
    I think the council have made a good choice in blocking it, I am all for people needing homes etc but to keep building higher on properties is not the way to achieve it.

    I didn’t check planning portal, i relied on my conveyancer. The planning was put in on 16th February and the letter from the council was dated 1st March. I exchanged on 2nd March.
    Always check the planning, searches won't always pick up what's happening.

    You would have to have gone through the searches  yourself because a conveyancer won't know what is important to you

    There is  the chance that something has happened between searches and exchange time.

    I suspect the history of the property, planning and licencing should have raised concerns.
