DCB Legal - help!

Hi

i got a letter of claim in January this year for a supposed parking ticket from July 2015. I ignored the letter thinking it will become statue barred soon. Today I have received a claim form for Northampton County court.

what should I do? If I offer to pay instalments will I still be given a CCJ? 
Is there anyway to fight it due to the timeframe? I don’t ever recall the parking ticket or any letters but I have moved house a few times since 2015. 

I have read a few threads here but not sure of the answers

    Who is the claimant ? HIGHVIEW

    I would get a CCJ? If I pay in full can I avoid the CCJ? 

    The date is 29th April and the claimant is CP Plus GroupNexus

    If you lose in court , in several months time , pay in full asap , no CCJ

    You don't have a CCJ.

    You could have avoided this claim altogether had you simply come here at Letter Before Claim stage and responded, kept the solicitor busy in pre-action replies and strung it out to the 6 year deadline. 

    Too late now, you let them get the claim in just in time but you have no CCJ and no need to panic.

    YOU ARE HERE ON THIS FORUM AND WILL PAY NOTHING.

    If you are looking at this forum on a phone (your posts are very clipped so it looks like it) stop, and get on a laptop and read any other exact same Group Nexus CP Plus or Highview claim for the past couple of weeks.  We have dozens, all the same, loads from 2015.  They are easy to deal with and defend.

    Please just read some threads on a laptop and then read the sticky thread NEWBIES PLEASE READ THESE FAQS FIRST (2nd post about how to win in court, not the first post about how to appeal which you would have won in 2015 - absolute cinch). 

    Come back when you have found & read about ten Highview or CP Plus Group Nexus claim threads and tell us when you have done the AOS online following the pictures that walk you through it.  Of course you are not going to pay this scam after all these years. 

    Your credit rating is not at risk as long as you follow our advice like everyone else does with this batch of tedious claims.

    Thank you so much!! I will do that on a laptop and fingers crossed I can get it squashed. Really wish I had come here earlier but I thought i might get it to the 6 year point, really should have researched it here and then I would have known how to string it out! 

    I will be back when I’ve read up. Thank you! Relieved I don’t already have a guaranteed CCJ! Phew.

    Do the AOS online by logging into MCOL website with the password

    Then email a SAR to the DPO at group Nexus , attaching a copy of the claim form as proof of I D under the GDPR law to obtain all your data including the paperwork

    Then start reading twenty group Nexus HIGHVIEW court claim threads , to start your Defence template draft , same as everyone else

    Thank you, quick question, my name has changed due to divorce since then - will they want ID to show my previous name like marriage and divorce certificate or will they accept the claim form as ID?

    Another one sorry. I don’t think I have any defence. I don’t remember the ticket and I don’t remember the day in question. I do know it will have been a service station/McDonald’s car park where I used to go on my break from work, I don’t recall it being a pay and display I think it was free. What kind of defence could I have if I don’t remember?

    The MCOL website has a box where your current name to be known as can be added

    As for the SAR , you can include copies of 2 utility bills plus anything else to confirm that you are the data subject in question , even if it's the marriage certificate and decree nisi or whatever

    Nexus won't want to do this at all , so will obfuscate and try to block you , so check the ICO website for advice on Identity proof

    Ideally , do not use a passport or driving licence , even though Nexus will ask , and do not confirm being the driver either , a DPO should not be asking you questions other than confirming your identity as a data subject

    I'll assume that is the Issue Date on your County Court Claim Form. 
    Please confirm.

    With a Claim Issue Date of 29th April, you have until Tuesday 18th May to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Tuesday 1st June 2021 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
